Dear Leigh Searcy,

This letter is in response to your open records request received by the Kentucky State
Police on July 17, 2020. In your request, you asked for all records regarding additional
information on Trooper Jack Gabriel specifically his work status at this time. You also inquired
as to whether if any determination had been found regarding his role in assisting another
agency to detain two people during a Chase Bank incident in Lexington. Finally, you also
requested information about if Trooper Gabriel under investigation for any other officer
conduct the following day involving alleged comments made after a police chase in Lexington
that ended on Winchester Road near Executive Drive.

The Kentucky State Police have completed an administrative investigation of the


incident involving the Trooper at Chase Bank in Lexington. A review of the response to
resistance was also completed as a part of the investigation. The review found that application
of force was inappropriate for the situation, and in violation of KSP’s courtesy protocols and
appropriate conduct standards. The Trooper received a 5-day unpaid suspension as well as
remedial training in appropriate conduct and courtesy toward the public. 

However, after a diligent search for the other items you requested, the Kentucky State
Police did not locate any responsive records regarding Trooper Jack Gabriel role in assisting
another agency to detain two people during a Chase Bank incident in Lexington. Trooper
Gabriel is not under investigation for any other officer conduct the following day involving
alleged comments made after a police chase in Lexington that ended on Winchester Road near
Executive Drive.

If you wish to appeal this decision, you may do so by filing a complaint with the Office
of the Attorney General, Open Records/Open Meetings, The Capitol, 700 Capitol Avenue, Suite
118, Frankfort, KY 40601, pursuant to KRS 61.880(2), or by filing an original action in Franklin
Circuit Court under KRS 61.882. If you first appeal to the Attorney General but are dissatisfied
with the Attorney General’s decision, you may further appeal to Circuit Court pursuant to
KRS 61.880(5).
