With access to computers and people all over the world also comes the availability of material that
may not be considered to be of educational value in the context of the school setting. Ogden School
District has taken precautions to restrict access to controversial materials. However, on a global
network it is impossible to control all materials and a skilled and subversive user may discover
controversial information.

Internet access is coordinated through a complex association of government agencies, and regional
and state networks. In addition, the smooth operation of the network relies on the proper conduct
of the end users who must adhere to strict guidelines. The following guidelines are provided so that
you are aware of the responsibilities you are about to accept. In general, this requires efficient,
ethical and legal utilization of the network, Internet resources, software, and devices. If an Ogden
School District user violates any of these provisions, will be subject to corrective disciplinary action.
Certain violations of the Acceptable Use Policy could result in termination of employment with the
Ogden School District. The signature(s) at the end of this document is (are) legally binding and
indicates the party (parties) who signed has (have) read the terms and conditions carefully and
understand(s) their significance.
Consequences of a breach of this contract or violation of guidelines is clear and concise.

TERMS AND CONDITIONS

Acceptable Use - The use of your accounts and/or devices must be in support of education and
consistent with the educational and ethical objectives of the Ogden School District. Transmission
and access of any material in violation of state regulation or US is prohibited. This includes, but is
not limited to: copyrighted material, threatening, obscene or pornographic material, or material
protected by trade secret. Use for commercial activities is not acceptable. Use for product
advertisement or personal political lobbying is also prohibited.
Could include a section on the details of what is included under copyright or available for reuse/for
reuse with modification. I know in elementary we were concerned about recording read-alouds for our
students and the copyright laws pertaining to specific distance learning expectations.

Privileges - The use of your account(s) and/or devices is a privilege, not a right, and inappropriate
use will result in corrective disciplinary action. The Ogden School District will deem what is
inappropriate use.

Digital Citizenship - You are expected to abide by the following rules of digital citizenship. These
include (but are not limited to) the following:
● Be professional in your messages to others. Prohibited, unprofessional conduct
includes accessing, sending, creating or posting materials or communications that
are
○ Damaging to another person's reputation,
○ Abusive,
○ Obscene,
○ Sexually oriented,
○ Threatening,
○ Demeaning,
○ Harassing, or
○ Illegal

● Ogden School District monitors and may access all accounts and devices. All
communications and information contained in user accounts and devices should not
be assumed to be private. Activity relating to or in support of illegal activities may be
reported to the authorities.

Monitor Student Use of Technology - Staff must be aware that students have access to the
Internet from all of the school systems' computers. Teachers must use good judgment and closely
supervise their students' use of the network, Internet resources, software, and devices. Staff must
enforce the Student Acceptable Use Policy while supervising students. If a student is not following
the Student Acceptable Use Policy, report the issue to your direct supervisor.
It would be helpful for teachers to have guidelines on how to monitor student use (ie how to access
history on student laptops/ipads/accounts).

Websites, Blogs, Social Media, and Other Online Spaces - Posting to websites, blogs, social media,
and other online spaces is encouraged as a way to connect with others professionally, share
educational resources, create and curate educational content, and enhance the classroom
experience. When participating in personal or professional social media activities, during or outside
of contract hours, such activities must not violate other Board policies and procedures or otherwise
interfere with the employee’s job performance. The Board expects all employees to exercise
professionalism and good judgment in any social media activities. Furthermore, any social media
activities must comply with all applicable laws including, but not limited to, anti-discrimination,
anti-harassment, copyright, trademark, defamation, privacy, securities, and any other applicable
laws and regulations. Any employee wanting to create an official school, department, or classroom
website, blog, social media, or other online space, will be required to notify the direct supervisor.
What if the website/blog is private to only the students and teacher (ie seesaw blog with password)
would this also need to be approved?
Interested employees must contact the school administrator and the communications department
in writing and express their reasoning, interest, and any specific details pertaining to the account.
Does this pertain to students creating blogs for classroom purposes as well? If a teacher wants to
redefine their lesson by having students post work to their student blogs would the teacher first need
to have it approved by their administrator and the communications department?

Provided Services - Ogden School District makes no warranties of any kind, either expressed or
implied, for the electronic information resources it is providing. The Ogden School District will not be
responsible for any damages an employee suffers while using these resources. These damages may
include, but are not limited to, loss of data as a result of delays, employee errors or omissions, or
non-deliveries or service interruptions caused by a network system. Use of information obtained by
the network system is at the employee's own risk. Ogden School District specifically denies any
responsibility for the accuracy of information obtained through the electronic information
resources.

Security - Security on any Ogden School District account(s) and/or devices is a high priority. If you
feel you can identify a security problem on any Ogden School District account(s) and/or devices, you
must notify your building/department supervisor who will notify the IT Security Officer. Do not
demonstrate the problem to other users. Do not use another individual's account. Attempts to login
to the network, Internet resources, software, or devices as a system administrator will result in

cancellation of user privileges. Any user identified as a security risk may be subject to corrective
disciplinary action.

Vandalism - Vandalism is defined as any malicious attempt to physically or digitally harm or destroy
data and/or equipment of another user or the Ogden School District. This includes, but is not limited
to, the uploading or creation of malicious software, defacing digital assets, or damaging hardware.

Digital Trespassing - Upon notification of denied access to the network, Internet resources,
software, and devices, employees found accessing or attempting to access Ogden School District’s
digital resources will be subject to appropriate disciplinary or legal action.
How should employees be able to tell if they are denied access or should be able to request access? I
am thinking in regards to some google docs that an employee may not have permissions to view but
has been sent by an administrator or district coach.

Intellectual Property - Any work or data created within the scope of your contract is the property
of Ogden School District and may not be sold, maliciously altered, or deleted if the employee is
under disciplinary action, or has provided notice of resignation or retirement.
This includes all resources created for lessons during the employment with the OSD.

Updating User Information - The Ogden School District may occasionally require new or updated
registration from you to continue use of the network, Internet resources, software, and devices.

Exception of Terms and Conditions - All terms and conditions stated in this document are
applicable to the Ogden School District in addition to UETN. These terms and conditions reflect the
entire agreement of the parties and supersede all prior oral or written agreements and
understandings of the parties. These terms and conditions shall be governed and interpreted in
accordance with the laws of the State of Utah, and the United States of America.
Could include a link to the resource here for quick and easy access. https://uetn.org/

I understand and will abide by the above Terms and Conditions for Internet and network use. The
signature(s) at the end of this document is (are) legally binding and indicated the party (parties) who
signed has (have) read the-terms and conditions carefully and understand(s) their significance. I
further understand that any violation of the regulations above is unethical and may constitute a
criminal offense. Should I commit any violation, my access privileges may be revoked, disciplinary
action and/or appropriate legal action may be taken.

CONDITIONS OF ACCEPTABLE USE

Ogden School District (OSD), in pursuit of meeting student’s educational needs, has access to the
network, Internet resources, software, and devices. This educational opportunity has been made
available to students and teachers in the Ogden School District. The OSD believes that the valuable
information and interactions, available through computer network communication, are effective
ways to educate students and promote digital citizenship.
I did not read any promise for Accessibility to Users with Disabilities. I understand this is an agreement
for students, there should also be an agreement to students with disabilities for what the district will
do for them.

With access to the network, Internet resources, software, and devices comes the availability of
materials that may not be considered to be of educational value. The Ogden School District and the
Utah Education and Telehealth Network have taken precautions, including filtering, monitoring, and
logging, to restrict access to objectionable materials. It is however, impossible to control all materials
and users may come across controversial or inappropriate information. We believe that the
educational opportunities far outweigh the possibility that users may obtain objectionable material.

To maximize the educational experience when using the Internet or local area network, the
following specific uniform practices and guidelines will be enforced.

TERMS AND CONDITIONS

Digital Citizenship - When using the Ogden School District’s network, Internet resources, accounts,
and/or devices, you are expected to abide by the following rules of digital citizenship. These include
(but are not limited to) the following:
1. Respect for Privacy

entities.
2. Online Behavior

disrespectful language.
○ You will not harass another person.
○ You will not make personal attacks including but not limited to prejudicial,
discriminatory, or defamatory statements.
Love that this is included. Meaningful work against cyber bullying is very important for our current
circumstances.
3. Social Media
○ You will not access social media accounts using the network, Internet resources,
accounts, or devices unless formally approved by a teacher or administrator
employed by the Ogden School District.
4. Safety
○ You will inform the teacher immediately if you have received any inappropriate
messages.
○ You may not use the network, Internet resources, accounts, and/or devices to set up
non educational appointments.
○ You may not post, repost, or share personal information about yourself or other
people i.e. addresses, phone numbers, school, etc.
Is this also addressed to students who may fall victim to cyber bullying? Is there a procedure for
students to report cyber bullying if they are the victim or notice it happening to other students?
5. Inappropriate Access to Material
○ You will not use the network, Internet resources, accounts, and/or devices to access
material that is profane or obscene.
○ You will not use the network, Internet resources, accounts, and/or devices to access
material that is directed toward discrimination, hate literature, or acts of violence.
○ You will immediately notify a teacher or administrator employed by the Ogden
School District if you mistakenly access inappropriate information.
○ You may not download or upload software to a device without specific permission
from a teacher or administrator employed by the Ogden School District.
6. Illegal Activities
○ You will not attempt to gain unauthorized access to any network, Internet resources,
accounts, and/or devices.
○ You will not use any network, Internet resources, accounts, and/or devices to engage
in illegal activities.
○ You will not create or share malicious software.
7. Plagiarism and Copyright Infringement
○ You will not plagiarize information found on the Internet.
○ You will not reproduce work that is protected by copyright. If you are unsure of
copyright guidelines or what constitutes plagiarism ask your teacher for further
understanding.
8. Vandalism
○ Vandalism is defined as any malicious attempt to physically or digitally harm or
destroy data and/or equipment of another user or the Ogden School District. This

includes, but is not limited to, the uploading or creation of malicious software,
defacing digital assets, or damaging hardware.
Is damage to a school device (at home or at school) considered vandalism? What is a lost device
considered? Who is held accountable for the damaged or lost device? I know this was a huge question
teachers had when we went into distance learning and will continue to be of importance as we
continue in the year coming.

Security - Security on any Ogden School District account(s) and/or device(s) is a high priority. The
Ogden School District and the Utah Education and Telehealth Network have taken precautions,
including filtering, monitoring, and logging, to restrict access to objectionable materials. In this
interest,
● You cannot allow others to use your passwords, accounts, or devices.
● You are responsible for your individual accounts and/or devices.
● You will immediately notify a teacher or administrator employed by the Ogden School
District if you have reason to believe that there is a security problem.

Purchases - The following statements refer to a student’s use of the network, Internet resources,
accounts, and/or devices regarding purchases.
● You may not make purchases using the network, Internet resources, accounts, and/or
devices without expressed written permission from your parent/guardian and school
officials.
● The district/school will not be held responsible for purchases made by a student.

Use of Resources - Although the information and interactions available on the network, Internet
resources, accounts, or devices are valuable the use of these resources is not unlimited.
● You will use the network, Internet resources, accounts, and/or devices only for educational
and career development.
I assume that career development includes job applications or college applications for high school
students? But above it states that students "will not use the network or devices to set up non
educational appointments", this could also include job interviews. Descriptive language here could be
useful for students to better understand the limits.
● You will not subscribe to discussion groups, mailing lists, or chat groups that have not been
formally approved by a teacher or administrator employed by the Ogden School District.
● Upon notification of denied access to the network, Internet resources, software, and devices,
students and/or parents found accessing or attempting to access Ogden School District’s
digital resources will be subject to appropriate disciplinary or legal action.

RIGHTS AS A USER

Search and Seizure
Very clear. Well detailed of students' privacy rights within the school network and devices.
● There is no privacy pertaining to the contents of your files on the network, Internet
resources, accounts, or devices.
● Routine monitoring and maintenance of the network, Internet resources, software, and
devices may lead to the discovery that you have violated the Acceptable Use Policy for
Students.
Quick Links:
Acceptable Use Policy For Employees/Other Adults | Acceptable Use Policy For Students

● A search of individual accounts, devices, or media, etc. will be conducted if there is
reasonable suspicion that the Acceptable Use Policy for Students has been violated.
● Parents/guardians have a right to request to see the contents of their student’s accounts or
devices at any time.
Student Data Privacy considering FERPA, HIPPA, and COPPA could be linked or included here for
parents to understand the school districts privacy policy for student data.

Due Process
● The district will cooperate fully with local, state, or federal officials in any investigation
related to illegal activities conducted on the network, Internet resources, software, or
devices.
● You have the right to be heard by a neutral administrator if there is a claim that you have
violated this policy.
This is very interesting and important detailed wording. Neutral meaning unbiased, but does that
inherently mean an administrator that does not know the student personally? Curious about what the
conditions are to elect the neutral administrator hearing these claims.

DISTRICT RIGHTS

The Ogden School District reserves the right to restrict access to any student that is suspected to be
in violation of the Acceptable Use Policy for Students until that violation can be resolved.

The Ogden School District will not be held responsible for unauthorized use of the network, Internet
resources, software, or devices to purchase products or services. The Ogden School District has the
right to maintain a history of a student’s Acceptable Use Policy for Students violations.
How long does the district maintain this history? Is this information passed along if the student
changes schools/districts?
