AGENCY ON COST PLUS PERCENTAGE BASIS” for Bridge package No. 1 RIDF-XIV
of NABARD programme”./ Proposal for rescind of work no. 1 “Constn. of RCC Bridge
of span 3x35.00 = 105.00M over river Khowai at Ch. 0.75 Km on the road from
Seoratali to Paharmura under Khowai Block”.

Name of work:
1. Constn. of RCC Bridge of span 3x35.00 = 105.00M over river Khowai at Ch. 0.75 Km on
the road from Seoratali to Paharmura under Khowai Block.
2. Constn. of RCC Bridge over river Khowai on the road from Teliamura(Dasamighat) to
Baishgharia under Teliamura Block (Span- 140 M)
3. Replacement of existing causeway over localcherra by RCC bridge on the road from TA
road to Khasiamangal at ch. 1.00 km to 2.00 km.
4. Construction of RCC bridge over river Howrah on the road from Champaknagar to
Bridhibazar via. Balram thakur paraat ch. 0.20 Km.
5. Construction of RCC permanent Bridge over river Cicima (Chainage 1.20 km) on road
from Karaiban(NH 44) Jarulbachai.

Stipulated time for Completion : 24 (Twenty four) Months.
Agency: M/S. Simplex Projects Limited, Nillie Sengupta Sarani, Kolkata-700087, West Bengal.

A Memorandum of understanding (MoU) was signed on 13/03/2009 in between Executive

Engineer, PWD(R&B), Teliamura Division, and Director, M/S. Simplex Projects Limited, Nillie
Sengupta Sarani, Kolkata-700087, West Bengal to execute the above mentioned RCC bridges on
Cost Plus basis @ 48.00 % above on SOR’2008, including preliminary survey, preparation of
preliminary drawings, detailed survey and sub-soil investigations, preparation of detailed drawings
and structural drawings , preparation of detailed project report based on detailed estimate,
execution of the project, landscaping and other items of work. The work order was issued to M/S.
Simplex Projects Limited, Nillie Sengupta Sarani, Kolkata-700087, West Bengal vide this office
letter No. F 5(84)/EE/TLM/4120-40, dated 03/07/2008 with a stipulation of 24(Twenty four)
months to complete the project. The stipulated date of completion as per work order was on
17/07/2011, which has already been expired well before.

Now, if we look at the progress of each project as upto date, it can be seen that work No.
3,4,5 is executed and completed in all respect by the agency and work no. 2 is almost 90%
complete. But if we look at work no. 1, i.e RCC bridge at Seoratali, it is found that work is
suspended since 2011. DPR for the work was approved by the department on October, 2010, with
DPR value Rs. 10,00,90,113.00. As per the clause 9 of MoU, date of completion was October,
2012. A long period of almost 09(Nine) years has already lapsed in between, and till date the work
is merely a negligible percentage complete. After casting one no. abutment well and one no. pier
well upto 7.20 mt. each, agency suspended the work and till today and failed to resume the work.

Several correspondences including discussion at various departmental review meetings have

been made with the agency for completion of the work. But all persuasions made by the
department during this long 09(Nine) years went in vein. During the meeting held with the Chief
Engineer, PWD(R&B), Tripura, at his chamber alongwith the agency/ representative and PWD
Oficials on 05/12/2018, it was committed by the agency that work of Seoratali bridge will be
resumed by 25th December 2018, but failed to fulfill their commitment and till today work is not
resumed. Executive Engineer, PWD(R&B), Khowai Division, vide his letter No. F.
10(23)/EE/PWD/KHW/5113-16, dated 24/02/2020 (Copy enclosed), expressed his dissatisfaction
over the agency due to their poor performance and expecting that there is no probability of
executing the work by the agency.

 On carefully studying the MoU, it is found that there are 2 (Two) provisions kept for rescind
and termination of work vide clause 11 (iii) and clause 11(iv).
As per clause 11 and its subsequent clauses of MoU, the agency M/S. Simplex Projects
Limited, had already been asked to deposit Rs. 1,00,09,011.00 (Rupees One crore Nine thousand
Eleven) only as vide this office letter No. F 5(84)/EE/TLM/26-29, dated 15/04/2020 (Copy
enclosed) which is yet to be adjusted.
Considering present situation, it is understood that the agency is not interested/unable to
execute the work of Seoratali Bridge in near future.
As such, it is proposed to rescind/terminate the work as per clause of MoU for the interest of
the work.
All related documents/correspondences are placed in file with seriatim.
Recomendation of the competent authority is required.
