With due respect, 1 would like Lo in fo rm you that, 1 had completed 25 (twenty
-five) years of
co ntinuous and sa ti sfactory service or my scrvice career up-to the afternoo
n of the day 24'" November
20 18 when I was posted under the orticial jurisdiction of the Additional
Chief Engineer, Planning &
Des ign Unit , PW (R&B) Department, Ne w Secretariat Building , Agartala
, Tripura. Therefore, I was
entitled to financial benefit as per provision under Sub-Rule (4) and Sub-Rule
(6) of Rule-12 i.e., Modified
Assured Career Progression Scheme (MA CPS) with effect from l" day of
April , 2017 of Tripura State
Civil Service (Rev ised Pay) Rule 20 17 & rirst Amendm ent Rul e, 2018 as a right
had accrued in favour of
me . But, as thc same was not crcdited into my sa lary accou nt in time, due to procedu
ral delay inter-alia for
11011-excrcising of power as delegate d under Sub-Ruic (4) of Rule- 12 of
Tripura State Civil Service
(Revised Pay) Ruic 201 7 upon the Additional Chief Enginee r, Plannin g &
Design Unit, PW (R&B)
Department, Tripura being Head or O nice. Finally, I had to prefer an application
on 06-11-2019 addressed
to the Principal Secretary, PWD , Government of Tripura through the Additional
Chief Engineer, Plannin g
& Design Unit , PW (DWS) Department , PN Complex , Tripura after assuming
the charge of the Executive
Engineer in the forenoon of the day of23-08 -20 19.
However, surprisingly , TA to Superintending Enginee r, Planning & Design
Unit, PW (DWS)
Department, PN Complex , Tripura has requested me to re-submit the same
after regularization of
Disciplinary Proceedings vide, letter under reference which was an onward transmi
ssion of the letter No.
F. 6 (23) - PWD (GE) / 2017 (S-IV) / 19, 156 dated 29-02-2020 of Shri Susanta
Dutta, Deputy Secretary,
PWD, New Secretariat Building, Tripura .
ln this context, it is pe1iinent to mention here that in the year 2018 when the
right had accrued in
favour of me, no disciplinary proceeding was pending against me. The
undersigned had received
memorandum dated 30-08-2019 of the Secretary to the Government of Tripura
(Discip linary Authority) ,
GA (AR) Depa1iment only on 03-09-2019 as served by Shri Susanta Dutta,
Deputy Secretary, PWD,
Tripura vide his letter No. F. 1(11)-PWD (E) / 2016 / 8,429-30 dated 31-08-2
019 . Thereafter, 2 (two)
Orders bearing No. F. 11(44)-GA (AR) / 2016 / 54-56 dated 06-01-2020 and
No. F. 11(44)-GA (AR) I
2016 / 57-60 dated 06-01-2020 were also received on 17-01-2020 as served by
Shri Susanta Dutta, Deputy
Secretary, PWD, Tripura vide his letter No. F. 1(11)-PWD (E) / 2016 / 16,604-
05 dated 15-01-2020.
Therefore, in view of the right which had accrued in favour of me, I cannot
be denied from the fin ancial
benefit which l am entitled to .
Under this perspective, I beg to submit this representation before your kind
self to consider my
name for getting the financial benefit under MACP in exercise of power delegate
d under Rule-12 , Sub-
Rule (4), Sub-Rule (6) ofTripu ra State Civil Service (Revised Pay) Rules 2017
and 1st Amendment Rule,
2018 with due weightage to my seniority in the service considering the fact that
l have already completed
25 years of continuous and satisfactory service on 24-11-2018 as per prescription
of the Rules in force .
And for this act of kindness, I, as in duty bound shall ever pray.
