An appeal was filed by Ms. Uzma Kardar against the order of sub-committee of Central
SCAD. The impugned order expelled Ms. Kardar from the basic membership of PTI as
severe punishment.

On the bare perusal of severe punishments as provided in Clause XII (2.) on Page 79 of the
Pakistan Tehreek e Insaf Constitution, the following disciplinary violations are categorized
as ‘Severe”:

i. Financial Irregularity of more than Rs 50,000;

ii. Contesting any election against the Party ticket holder;

iii. Maligning/Slandering the Party on any public forum/media


(Social/Print/Electronic);
iv. Opening bank account in the name of PTI without written approval of Central
Finance Board (CFB);

v. Three times violation of CFB Manual Policy/Guidelines/SOP/Decisions;

vi. Taking bribe in cash or kind in return for issuing party tickets/notifications or
exploiting party position in any form for personal gains;

vii. Work Place Sexual Harrasment;

viii. Verbal/physical abuse or use/threat of physical violence or financial inducement to


any member of SCAD;

viii. Any two convictions under column two (Moderate); and

ix. Any three convictions under column one (Mild).

The question to be determined is whether the Appellant violated any provisions of the
disciplinary code that warrants an expulsion from the Party.

The Appellant states that she was having a phone conversation with Mr. Osama Tayyab,
who by profession is a journalist. She had known him for over 8 years and enjoyed a very
cordial relationship. She however, states that Mr. Osama Tayyab leaked the phone
conversation at the behest of certain people who had personal issues with her and she was
entrapped.

Decision:

After hearing the Appellant, it is held that Ms. Kardar committed severe disciplinary
violation. She maligned the Party as she was knowingly speaking to a journalist and it is
their professional obligation to bring any information on the public forum/ media.

The Appellant has casted slanderous allegations on numerous individuals in her phone
conversation including senior party members, which is defamatory in nature.

The decision of sub-committee of SCAD is upheld. The Party is directed to remove her
name from the register of basic membership. The Appellant is also directed to immediately
resign from the membership of Provincial Assembly, Punjab as her conduct was
unbecoming of a public office holder.
