According to Section 8 the employer will pay the person representing deceased weekly
compensation equivalent following percentages of average weekly wages, should not be more
than 50 pesos nor less than 10 pesos, of the deceased employee:
a. Widow, no children 45%
b. Widow with 2 children 50%; 3 or more children 60% may be adjusted by Workmen’s
Compensation Commissioner.
c. no widow with children 40% with 10% each if more than 2 children
d. totally dependent mother or father 40%; partly dependent 25%, both parents dependent ½
of such compensation
Sec 12 note: total weekly compensation not to exceed average weekly wages computed
according to Sec. 19 nor weekly compensation can exceed 4,000 pesos
Sec. 19 of Art. 3428 the average weekly wages will be computed in such manner that it shall be
the best computation of weekly earning during the twelve weeks next preceding his injury.
Provided, if wages cannot be properly computed due to shortness of employment or cessation
of employment, consideration will be based on weekly wages earned during the last twelve
months preceding injury of person with the same work and grade under employer, if no person
so employed, consideration is based on average weekly wages earned by person employed in
the same grade in same district or locality.
