Subject: PCIJ's request for clarification re SALN

Dear Justice Del Castillo:

Greetings from the Philippine Center for Investigative Journalism! We hope this letter
finds you well.

We write in connection with a story that the PCIJ is doing about the Statements of
Assets, Liabilities, and Net Worth (SALN) of the justices of the Supreme Court.

We have reviewed and validated the dataenrolled in your 2011 SALN, according to the
spirit and letter of Republic Act No. 6713 (Code of Conduct and Ethical Standards for
Public Officials and Employees) or the SALN Law.

As you are well aware of, The SALN Law aims to provide the public, not just the
government, a basis for "monitoring the income and lifestyle of public officials and
employees in compliance with the constitutional policy to eradicate corruption, to
promote transparency in government, and to ensure that all government employees and
officials lead just and modest lives, with the end in view of curtailing and minimizing the
opportunities for official corruption and maintaining a standard of honesty in the public
service" (see, for instance, Oca v Usman, A.M. No. SCC-08-12)

In the spirit and letter of The SALN Law, we respectfully request you to please comment
on the following matters:

1. You declared the current fair market value of your house and lot in Cainta in your
2011 SALN at only P2,000,000, or a decrease from the P2,600,000 current fair
market value of the same property that you declared in your 2002 SALN. Please
explain.

2. You declared the same current fair market value of your condominium unit in Makati
in your 2002 and 2011 SALNs, however. Kindly clarify.

3. In your 2002 SALN, you specified the years when you acquired your personal assets
and listed the companies in which you have acquired shares of stocks. In contrast,
your 2011 SALN do not offer the same details.

Could you please specify when you acquired the following personal assets and in
which companies: stocks, bonds and notes, mutual funds, private insurance, time
deposits, money market placements, and equity in partnership/savings and loan
association?

4. You declared no improvements made on all four of your real properties that you said
you acquired in 1983, 1998, 2005, and 2008, respectively. Please inform us: Are
these properties raw land? Please explain.

5. Your 2002 and 2011 SALNs reflect an increase in your net worth from P27.25 million
to P108.9 million or 299.62 percent over the last nine years, or an annual average of
33.29 percent. May we know if you have other sources of income apart from your
salary as associate justice?

6. Our reverse search of corporate records of the SEC showed that the names
"Mariano C. Del Castillo" and "Cynthia Roxas Del Castillo" are listed as incorporator
and president, respectively, of the Anna Patricia R. Del Castillo Foundation for Law
and the Arts, Inc.

Moreover, SEC records listed the name "Cynthia R. Del Castillo" as incorporator of
eight other corporate entities, namely Atea Tierra Corporation, Galahad Philippine
Holdings, Inc., KFE Logistics Holdings Limited Inc., Knightgold Properties &
Insurance Agency Inc., OFIC Philippines, Inc., Oro Harmonia Corporation,
Transunion Information Solutions Inc., and UnitedHealth Group Global Services, Inc.
Kindly inform us: Do you and your wife have any business interest in and financial
connections to this day with these business entities?

7. In your 2011 SALN, you declared that you received a total of P1,303,831.24 in
salary as associate justice but did not report any amount of allowances and other
compensation. Please clarify: Did you receive allowances and other compensation
as associate justice in 2011? If yes, how much in allowances did you receive in 2011
as associate justice? Did you pay the appropriate taxes on these allowances?

We would appreciate it if you could please respond to us as soon as practicable, or


before October 25, 2012.
