DRAFT TENANCY AGREEMENT

THIS INDENTURE IS MADE ON THIS THE ____ DAY OF ___________, 2019 AT SILIGURI

BETWEEN

____________________________– hereinafter called the “FIRST PARTY/ LANDLORD”


AND
____________________________– hereinafter called the “FIRST PARTY/ TENANT”
WHEREAS the First Party is the absolute owner of a ____________________________which is more
particularly described in the schedule below having permanent, heritable and transferable right, title and
interest therein free from all encumbrances and charges whatsoever.
AND
WHEREAS the Second Party in need of such a unit approached the First Party to let out the below
scheduled premises on monthly rental basis under certain terms and conditions to which the First Party has
also agreed.
NOW THIS INDENTURE WITNESSFTH that in pursuance of the aforesaid offer and acceptance by and
between parties above named entered into this Agreement of Tenancy incorporating therein terms and
conditions as agreed upon by and between themselves and agreed to abide those terms and conditions as
written hereunder.
TERMS AND CONDITIONS

1. That the monthly rent for the said below scheduled premises / Shop has been fixed at Rs.
__________________only per month and this rate of rent and tenancy will remain in force for a
period of ______________months on and from ________________shall be ended on
_________________.

2. That the Second Party shall pay a advance of ___________________only as an advance to the First
Party for the said below scheduled premises and the said advance amount will be adjusted at the time
of completion of tenancy tenure.

3. That the tenant shall use the said tenanted premises for his business purpose only and not for any other
purpose or purposes.

4. That the tenant shall be entitled to use the tenanted premises only for his legal business purpose and
shall not utilize the same for any other purpose or other purposes.

5. That the tenant shall not make any material alteration and addition to the tenanted premises without
the consent of the landlord in writing.

6. That the tenant shall not sub-let or transfer the tenanted premises or any part thereof to any other
person or persons.

7. That the tenant shall pay the electricity bill as per the meter reading installed in the tenanted premises.
8. That tenant shall not keep or store any inflammable or combustible goods in the tenanted premises nor
shall keep any contraband items in the tenanted premises.

9. That the tenant shall not use or allow to be used the tenanted premises for any immoral or illegal
purpose nor shall cause or allow to be caused nay nuisance and/or annoyance to the neighbors
including landlord.

10. That in case the tenant violates any condition hereinabove in that event the landlord shall be at the
liability to evict the tenant from the tenanted premises and to take possession of the same.

11. That in case the tenant wants to discontinue the agreement of tenancy than he has to inform the
landlord by way of two months advance notice in writing.

12. That in case the tenant wants to renew the tenancy agreement then it could be done with the mutual
consent of both the parties.
