Punishment under the Penal Code

  The Penal Code in sections 53 to 75 has provided for the general


provisions relating to punishment for different offences.

  Section 53 of the Code makes the offenders liable to the


following punishments :
1) Death;

2) Imprisonment for life;

3) Imprisonment, rigorous with hard labour, or simple;

4) Forfeiture of property;

5) Fine.

Death Sentence
The sentence of death is the most extreme
punishment provided under the Code.
  The following are the cases where death sentence may be awarded at
the discretion of the court:

a) Waging war against the Government (Section 121).

b) Abetment of mutiny committed (Section 132).

c) Fabricating or giving false evidence as a result of which an innocent


person suffers death (Section 194).

d) Murder (Section 302)

e) To abet an insane, minor or intoxicated to commit suicide (Section


305).

f) Dacoity with murder (Section 396).
