While affidavits that have been notarized are public documents if they are acknowledged before a
notary public, these are still considered hearsay unless the affiants themselves are placed in the witness
stand to testify thereon. The reason for this rule is that, generally, they are not prepared by the affiants,
but by another one who uses his own language in writing the statements, parts of which may be either
omitted or misunderstood by the one writing them. Moreover, the adverse party is deprived of cross-

The cover sheet cannot just be concluded to be that of a person it purports to be. The source is highly
questionable and any interested parties

said photos; Person/s who took the picture or the person/s who posted the same was not presented in
court and identify the same.

To say (not even necessarily to prove) that because of the photos accused and certain Monali have illicit
relationship is a dangerous precedence and it is totally taken out of context; it is only the by-product of
malicious mind of the private complainant who is overly jealous person and is suffering from Antisocial
with Narcissistic Personality Disorder.
