the person who would get his son. ' B' searched the boy and handed over to him to 'A'. A denied to
give ten lakhs rupees to B. Can 'B' recovers the sum from 'A’?
17. ‘A' is having a distillery, manufacturing liquor. 'B' is a licensed contractor to sell the liquor. There
is a contract between'A'and 'B' for the supply of Iiquor at a fixed rate for one year.All of a sudden,
the government prohibits the liquor. Can 'A' compel 'B' for performance of contract? Decide.
18. Bharath was a professional football player and was on the retainer list of the defendant-club. He
wanted to seek employment in another club. The defendant-club objected him in doing so, and also
petitioned to the association and the League of clubs, requesting not to give employment to
Bharath. Bharath-the plaintiff wants to sue the club. Decide.

15. Mahatma Gandhi rightly said to compromise the parties to the possible best and to make the party
to get the remedy in a speedy way. It is always a question for discussion that where to get adequate
information about the redressal agencies to file a case. There shall be a proper counselling and
impression about the pros and cons of the case. And also to reduce the unnecessary litigation rate
the legal service authority is introduced to avail the free legal aid services to women, poor and
weaker sections for their adequate relief. In the initial stage both the parties are called for
counselling. If the parties are not willing to compromise and where no way to set aside the case
they may approach to ordinary courts.
Questions : 1) Who suggested to compromise the parties to the litigation.
2) What is the significance of the free legal aid?
3) What is the stand of the aggrieved party?
4) Who are the beneficiaries under the legal service authorities?
5) What do you understand by counselling?
16. Translate in to Telugu
The liberty and significance of individuality is the main concept of framing the Fundamental
Rights. The greatness of Fundamental Rights was clearly incorporated in Part-III of the Indian
Constitution and are significant in nature. All the citizen are treated equal before law and
fundamental rights cannot be waived. Violation of this right will be challenged before the apex
court i.e. Supreme Court and High Courts under the Articles 32 and 226 respectively.

company. No such resolution was passed. Is company liable for the debt?
16. The promoters of a company before its incorporation enter into an agreement with A to buy a plot
of land on behalf of the company. After incorporation the company refuses to buy the said plot of
land. Has A any remedy either against the promoters or against the company.
17. R transferred his shares to two persons and lodged the certificate with the company. The company
certified the transfer. But instead of destroying his original certificate returned it to R, who
borrowed money in the certificate from S. Decide the liability of the company to L, giving reasons.

money from bank. What would be the defence of the king?
16. Lethal fumes emitted from chemical plant situated in the border of state X caused severe damage
to the property of its neighbour state Y. Y sued X. Under what principles of customary
international can X become liable?
17. A mining company sued state X for breach of mining contract and also for commiting trespass into
its premises. The local court awarded damages for breach of contract and tort. When the state X is
succeeded by new state Y, the latter refused to pay the damages by arguing that as a new state it has
no obligation. Decide.
18. A ship collided with another ship on high seas. The flag state of the defaulted ship, X has
contended that it will try the captain of the ship. But Y, the state of the victim ship contested that it
will try him since the persons who died in the accident are its nationals. State practice revealed that
since long countries at defaulting ships have been trying the offenders of collision. On this basis X
argued that it has jurisdiction by virtue of international custom – decide.
