Sub: Requesting kind consideration of the impending fee-catalogue, viz. quantum


furnished therein, notified through Office Memorandum bearing Letter No.-
CNLU/45(a)/2020-323 dated 07/08/2020.

Ref: This is in reference to the communications made to our respected Vice-Chancellor


madam through application dated 11.08.2020 by the final year students of CNLU
and a separate application by the junior batches combined on 10.08.2020, requesting
her kind re-consideration of the fee catalogue notified through Office Memorandum
bearing Letter No.- CNLU/45(a)/2020-323.

Hon’ble Mr. Justice Sanjay Karol Sir,

We, the undersigned, all bona fide students of your esteemed institution write to
you today, perturbed, by the inaction and opaque retort, on the part of the University
administration, insofar as the fee catalogue accommodated in Office Memorandum
bearing Letter No.- CNLU/45(a)/2020-323 dated 07/08/2020, is concerned.

Sir, we have been diligently pursuing the University administration in matters


pertaining to the submission of annual fee for the academic year 2020-2021. Upon
publication of the aforementioned memorandum, we communicated two
representations one from the 5th year students of batch 2016-2021 and another from
the 2nd, 3rd and 4th year students of batches 2019-2024 , 2018-2023, 2017-2022
respectively. The former representation was communicated on 11.08.2020 via e-mail
from the common batch email id titled ‘cnlubatch2016-2021@outlook.com’, the latter
representation was physically communicated on 10.08.2020 (bearing physical
acknowledgment receipt).
Through both representations, all the existing batches enrolled in the university
conveyed a request of fee reduction. Although, the aforesaid Office Memorandum
bore waivers for some chargeable heads, the heads of ‘Facilities Fee’ and ‘Library Fee’
were left untouched. Our repeated efforts to establish communication in this regard
were turned down, the only reply furnished to us was to the above mentioned email
address wherein it was stated that the matter has been considered and the University
does not think it to be feasible to reduce the fee any further.
In both representations, four major considerations were scrupulously delved into; they
are explicated herein below:
(i) The untenable nature of the ‘Facilities Fee’ to the tune of Rs. 15,000/-
(Rupees fifteen thousand only) for the 5th year students of batch 2016-2021
and Rs. 16,000/- (Rupees sixteen thousand only) 2nd, 3rd and 4th year
students of batches 2019-2024, 2018-2023, 2017-2022 respectively; which is
the original amount as expressed in our fee structure.
We contended in this context that none of the university facilities were
being used since the university was closed down on and from 15.03.2020.
Further the existent Covid-19 threat and the current Academic Schedule
raises questions as to when the university gates will be thrown open to us,
if not posing clear indications of closure for the better part of the Academic
year 2021-2022.
(ii) The unsustainable nature of the ‘Library Fee’ to the tune of Rs. 5,000/- (Five
thousand only) being charged from all batches was requested to be remitted.
We contended in this context that the library has remained closed since
15.03.2020, thus no resources have been used by the students. It was further
stated that the uncertainty of circumstances renders it undeterminable as to
when if at all the library will open for the students.
It is pertinent to mention in this context that the Library had been made
operational, contrary to the directives of the state government dated
30.07.2020, vide official notification bearing Letter No.:
CNLU/45(a)/2020-310. Further, while including the abovementioned
chargeable head the university administration failed to consider, that
roughly 50% of the pupil enrolled in the university are not residents of the
state of Bihar, thus making it impossible for them to avail the benefit.
(iii) We requested pro rata deduction of the- Mess Charges for campus residents
and day scholars, Annual Room rent along with additional room rent as per
applicability and the Facilities Fee from the previous payment cycle, which
were not utilised from 15.03.2020 till the conclusion of our previous
semester.
These major chargeable heads were brought to light while excluding
minor heads. It was also highlighted that such an approach was due to, the
perilous circumstances that has dawned upon all of us and to portray our
zealous co-operation with the university administration and faculty
members to effectuate meaningful dissemination of knowledge.
(iv) Finally, the postponement of last date for payment of annual fee i.e.
31.08.2020 was requested. An additional month’s time i.e. till 30.09.2020 was
appealed for receiving the payment of reduced /re-considered fee.
Alternatively, it was requested that we be given the liberty to pay the revised
annual fee in instalments, citing BCI Advisory bearing number BCI:D:
314:2020(LE), dt. 27.07.2020.
According to the referred to Office Memorandum upon failing to pay the
annual fee before /on 31.08.2020, a penalty of Rs. 500/- (Rupees five hundred
only) shall be imposed till 15.09.2020 after which date an amount of Rs. 50/-
(Rupees fifty only) shall be charged every day.

Despite implied and explicit depiction of the lingering despair among the students,
owing to the dwindling economic structure and the onerous nature of the lump sum
payment, no consideration was tendered, insofar as the only reply opaquely diminished
all propositions as ‘not feasible’.

We, the undersigned seek to co-operate with the university administration, however,
the abysmal state of affairs, induced by the pandemic, has only added to our anxiety
but engendered the incapability of meeting the demanded fee as per the published Fee
Catalogue therefore exposing us to penal charges.

Thus, to preserve a congenial, learning environment for the students of this halloed
Institution, we, the undersigned have been constrained to approach the Hon’ble High
Court of Judicature at Patna for an immediate stay against the demand notification
(aforementioned Office Memorandum) as post 31.08.2020 any relief granted in the
matter shall become infructuous.
