Dear Ms. Talaroc:

Vis-a-vis your letter dated 24 August 2020, addressed to this office for the specific
request of delivering back your Quarantine Pass issued to you in accordance with
the Caloocan City Government policy on the new Quarantine Pass, which you
have returned voluntarily to this office, please see below our reply to the same, to
wit:

1) To reiterate, this office is not privy to the specific details of individual


resident schedules or itineraries but is only strictly following the mandate
and protocol as provided for by the City Government of Caloocan in the
issuance of the new Quarantine Pass. In cases where the schedule provided
for in the issued Quarantine Pass does not match the individual’s schedule,
it is incumbent upon the individual to adapt and conform to the schedule of
the Quarantine Pass issued to him/her as this is the ‘new normal’ under the
prevailing community quarantine that currently exists and being enforced.

2) As we have stated in our previous response, scheduled hearings with the


Barangay Lupon may be rescheduled to fit the schedule of your issued
Quarantine Pass. The Supreme Court has issued Administrative Circular No.
43 – 2020 where ALL the courts in the National Capital Judicial Region
SHALL BE PHYSICALLY CLOSED to all court users, while the HLURB is open
on weekdays, thus, this office does not see any compelling and profound
reason as to the need to replace the Quarantine Pass issued to you by this
office.

3) Additionally, you have failed to provide this office with any evidence of your
allegation that will serve as proof of your alleged barangay, court, and
HLURB appointments to convince this office of your need to be issued with
a different type of Quarantine Pass. Case law has defined "burden of proof'
as the duty to establish the truth of a given proposition or issue by such
quantum of evidence as the law demands in the case at which the issue
arises.

1. Being on the subject of proof, you have failed to again provide any
evidence substantiating your allegation that there are households who
received two (2) or three (3) colored quarantine passes. Please be advised
that this office is only strictly following the mandate and protocol as
provided for by the City Government of Caloocan in the issuance of the new
Quarantine Pass. The presumption of regularity in the performance of
official duties is an aid to the effective and unhampered administration of
government functions. Without such benefit, every official action could be
negated with minimal effort from litigants, irrespective of merit or
sufficiency of evidence to support such challenge. To this end, our body of
jurisprudence has been consistent in requiring nothing short of clear and
convincing evidence to the contrary to overthrow such presumption. It is
axiomatic that a public official enjoys the presumption of regularity in the
discharge of one's official duties and functions.

4) Finally, on your request to deliver to you the Quarantine Pass that was
issued to you by this office and which you voluntarily returned to this office,
please be advised that you are hereby informed that it is now incumbent
upon you to voluntarily retrieve and secure the same Quarantine Pass
issued to you from this office.

Wherefore, considering the foregoing, this office hopes that it has satisfactorily
responded to your letter request.
