ORDER TO SHOW CAUSE.

News reports issued after this court published the opinion of September 15 suggest that
a “spokesperson” for the Secretary has said he does not regard the declaratory judgment
as legally binding, or words to that effect.

Counsel for defendants must clarify his position no later than 3 p.m. on September 16,
failing which the court will assume the report is accurate and the Secretary will not
honor prior statements that he would abide by this court’s ruling. At that point, the
court necessarily will proceed to decide plaintiffs’ motion for preliminary injunction.
