DECISION

Accused Jaycee Barrun y Delgado, Rudy Delgado y Porcino,

Rayos were charged with the crime of Violation of City Ordinance No. 10
in an Information the accusatory portion of which reads as follows:

“That in the early morning of August 14, 2018, at the


shorelines of “Tatlong Pulo” in Barangay San Antonio, City
of Calapan, Philippines, which is within the jurisdiction of
this Honorable Court, the above-named accused, JAYCEE
BARRUN y DELGADO, RUDY DELGADO y PORCINO,
ROMNICK PORCINO y EVORA and ROLAND PORCINO y
RAYOS, in conspiracy with one another, without any legal
authority nor corresponding license or permit from the
proper government agency, did then and there, willfully,
unlawfully and feloniously fish/gather marine products using
compressor which was not allowed to be used, using M/B
SHAEINA, a motorized banca owned by accused SOFIO
ESCAREZ to the damage and prejudice of the environment.

Contrary to law.”

Upon being arraigned, accused Jaycee Barrun y Delgado, Rudy


Delgado y Porcino, Romnick Porcino y Evora, Roland Porcino y Rayos
and Sofio Escarez y Rayos duly assisted by their counsel, Atty.
Leoncia Ma. Cecilia M. Dimayuga, personally and voluntarily entered a
plea of GUILTY to the crime charged against them.

When queried, all accused informed the Court that they fully
understand the nature and consequences of their entering of a plea of
guilt.

A C C O R D I N G L Y, in view of their plea of guilt, judgment is


hereby rendered finding accused Jaycee Barrun y Delgado, Rudy
Delgado y Porcino, Romnick Porcino y Evora, Roland Porcino y Rayos
and Sofio Escarez y Rayos GUILTY beyond reasonable doubt as
principals of the crime charged against them in the aforequoted
Information, they are hereby sentenced to suffer the penalty of FINE
in the amount of ONE THOUSAND (P1,000.00) PESOS each, with
subsidiary imprisonment in case of insolvency.
