1. The allegation of the frustrated murder is considered as the factum probandum of the
case

2. These are the following evidences that are considered as the burden of proof
namely, Bahian’s admission that his head injury is caused by his own actions hitting his
head in the concrete pavement and the testimony of the witnesses saying that they did
not see any weapons such as bolo, iron bar or gun and it negates Bahian’s statements.

3. The burden of proof is on the side of the petitioners.

4. The petitioners were acquitted.
