The consequences of management not abiding by legislation and regulations in
a health and safety situation:
If the health and safety management department doesn’t abiding the rules and regulation and
legislation then they have to give penalties and those are Health and safety manager or
employer can be cross cutter or he can be suspended from his job. The HSE manager can be
punished by giving of fine up to 20,000euro.
A breach could result in a fine of anywhere up to or around £20,000 but if the company or
individual manager is found to be deliberately breaking the law or being seriously negligent in
carrying out the appropriate procedures that reduce the risk of injury, this can lead to unlimited
fines and or imprisonment. Prohibition notice may be issued to authorities if doesn’t in 21 days
or HSE can arrest or suspended from his job.
If any of these authorities find that the company or the individual is in breach of any health and
safety regulations, they may issue the person responsible with an improvement or prohibition
notice as an alternative to prosecution. This improvement notice states that the party
responsible is required to improve the breach within 21 days, but this period may be extended
in certain circumstances. Company can face a loss in production or employee turnover.
If there create an accident or any incident for this worker may not come to the workplace or
accident may become bigger that company may stop her production or shut down. For this the
production may stop and production loss can be happened and for this company can go to loss.
This is the consequence of management not abiding by legislation and regulation in the health
and safety situation.
