Case Note: 
Family - Divorce - Cruelty - Present appeal filed by appellant/husband against
order whereby divorce petition filed by him against respondent/wife on ground
of desertion and cruelty, dismissed - Held, respondent had relation with an
police officer before her marriage and she suffered from pregnancy and
miscarriage which reduced weight of respondent quickly - If appellant had been
told this fact before marriage, he might not have consented marriage - Despite
fact that respondent is a good lady but has created aforesaid situation because
of her own act and conduct concerning non-disclosure of her state of health and
concealment by her relation, acted as a mental and physical cruelty to appellant
which entitles him to a decree of divorce - As, marriage took place about 14
years ago and there is no child out of said wed-lock, it would be absolutely in
interest of justice to separate parties from each other - Therefore, findings of
Court below are reserved - Appeal allowed

Constitution of India - Article 142—Hindu Marriage Act, 1955—Section 13B—
Divorce by mutual consent—One of grounds under Section13B—Is living of
couple separately for one year or more—And not able to live together—In
instant case parties living separately for more than 7 years—As part of
agreement, appellant husband transferred valuable property rights in favour
of respondent wife—But after registration of such transfer—She withdrew her
consent for divorce—She still continues to enjoy property—And insists in
living separately from husband—Hence, power under Article 142 to be
exercised—Petition for grant of divorce by mutual consent
under Section 13B accepted.
