COMPLAINT AFFIDAVIT

I, Capt. Hector Barbossa, of legal age, Filipino, with home address at London St., Brgy
Tortuga, Makati City, after being sworn to in accordance with law, hereby depose and state that:
1. I am the captain of the fishing vessel Queen Anne's Revenge whose fishing
ground is located around the West Philppine Sea area;
2. That accused, Jack Sparrow, is the captain of the vessel Black Pearl and Jano
Gibbs, James Barnes, Steve Rogers, Nat Roman as its crew
3. That on October 2, 2019, the Queen Anne's Revenge set sail for our fishing
ground at the West Philppine Sea;
4. That around 4 in the afternoon on October 3, 2019, one of my crew, William
Turner, yelled ‘MGA PIRATA’;
5. That I immediately alerted the navy via radio frequency upon seeing Jack
Sparrow and his crew come aboard our ship;
6. That Jack Sparrow and his crew overtook the Queen Anne’s Revenge captain
and crew by their hostile behavior;
7. That upon reaching the captain’s bridge, Jack Sparrow and James Barnes pulled
out a gun, pointing it to the general direction of me and First mate Antonio Stark
inside the room and said ‘I am the Captain now’;
8. That Jack Sparrow and his crew then proceeded to haul the refrigerated cargo
loads from the Queen Anne’s Revenge to the Black Pearl;
9. That the seized goods were totaled 10 refrigerated cargo holds, each hold
containing 100 kgs of fishes of different variety and some of the crew’s valuables,
enumerated in Annex B;
10.Upon consultation with my lawyer, I understand that the acts of the accused
qualify for Piracy under the Revised Penal Code ;
11.Article 122 of the Revised Penal Code provides that Piracy is committed
robbery or forceful depradation on the high seas without lawful authority, done
with the intent to rob and in the spirit and intention of universal hostility;
12.That Article 122 provides for the elements which comprises piracy:

a.) There is a vessel on the high seas or Philippine waters

b.) The offenders aren't members of its crew or passengers (if the crime
was committed by any of the passengers or crew, it's not piracy anymore
but robbery on the high seas)
c.) That the offenders do either of the following:
• Attack/seize the vessel
• Seize part or all of its cargo, equipment or personal
belongings of its crew or passengers
 13.I am executing this affidavit to attest to the truth of the foregoing facts and for
the purpose of filing a criminal complaint for PIRACY against Jack Sparrow, Jano
Gibbs, James Barnes, Steve Rogers, Nat Roman

AFFIDAVIT

I, WILLIAM TURNER, of legal age, Filipino, with home address at London St., Brgy
Tortuga, Makati City, after being sworn to in accordance with law, hereby depose and state that:
1. I am a member of the crew of the Queen Anne's Revenge, a fishing vessel under
the captaincy of Hector Barbossa,
2. That on October 3, 2019, around 3 in the afternoon, as I was doing my patrol, I
heard a whooshing noise which I dismissed as a sound coming from the engine as
sometimes there may be mechanical difficulties
3. That as I was on a break beneath the gantry, I heard a soft whistle
4. That when I turned around, I saw the Black Pearl, already beside the Queen
Anne's Revenge
5. That I then yelled “MGA PIRATA” to alert the rest of the crew who were also on
a break
6. That as I yelled, one of the Black Pearl's crew, named GIBBS, had slapped my
mouth to silence me and then took out his gun and pointed it at me
7. That about five persons had unlawfully come aboard the Queen Anne's Revenge,
named Gibbs, Barnes, Roger, Roman and their captain, Jack Sparrow
8. That the five of of them, had a submachine gun with which they used to
intimidate all of the crew
9. That two of them including Jack Sparrow and Barnes then proceeded to the
bridge to overpower the Captain Barbossa, but not before Jack Sparrow gave
Gibbs the instruction to haul the 10 refrigerated cargo loads to the Black Pearl
10. That Roger and Roman then proceeded to haul the cargo loads while Gibbs stood
to watch the gathered crew of the Queen Anne's Revenge
11. That after an hour, after the cargo loads had been hauled to the Black Pearl, Jack
Sparrow and his crew left
12. That I execute this affidavity to attest the truth of the PIRACY incident in the
afternoon of October 3, 2019 at the West Philippine Sea with the Queen Anne's
Revenge committed by the captain and crew of the Black Pearl
