JUDICIAL AFFIDAVIT OF CYRUS PETER F. MEGRASO

I, CYRUS PETER F. MEGRASO, Filipino, of legal age, married, a

resident of Brgy. Asuncion, Maasin City, Southern Leyte, and an
employee of DENR CENRO Maasin, after having sworn to an oath in
accordance with law hereby depose and state that:

I am answering the questions asked, fully conscious that I do so

under oath, and I am also aware that I may face criminal liability for
false testimony or perjury.

1. Q. Do you swear to tell the truth, and nothing but the truth?
A. Yes Ma’am.

2. Q. What is your purpose of executing this affidavit?

A. To make a sworn statement to support the filing of
appropriate charges against Eduardo B. Braza.

3. Q. Can you narrate how the incident happened?

A. On October 7, 2020, at around 4’o clock in the afternoon, my team
arrived at the Baranggay Office of Manhilo, Maasin City to conduct a
field investigation or verification, based on the report made by Brgy.
Chairman Angelita A. Soliva regarding an unauthorized cutting and
gathering of Pagatpat tree species.

4. Q: What exactly was the report about?

A: Based on the said report, a certain Eduardo Braza, Jr., a resident
of the said barangay, injured, cut, and gathered the said mangrove
tree species.

5. Q: What happened next?

A: Upon arrival at the entrance of Eduardo Braza, Jr.’s residence, me
and my team saw an injured Miapi inside the shanty, and a bamboo
bridge which had poles made of six (6) pieces of Bakhaw.

6. Q: What did you do, if any?

A: We immediately did the inventory and scaling. It was found that a
total of seven (7) pieces of mangrove tree species were cut and injured,
which has a total gross volume of 0.24 cubic meter, having an
estimated market value of P1,680.00.

7. Q: Do you have anything more to change in your statements?

A: Nothing more, Ma’am.
