II. Level of awareness on the Anti-Photo and Video Voyeurism Act among
students of NLPSC

For each of the statements below, select the number which best indicates
how much the statement is applied to the awareness on the Anti-Photo and
video Voyeurism Act. There are no right or wrong answers. Do not spend too

1. If the person has the intent to capture an image
of a private area of an individual without their
consent, and knowingly does so under circumstances in
which the individual has a reasonable expectation of
privacy commits the offense of voyeurism.
2. If a person is involved in observing/recording
another person doing a private act and knowing that the
person being observed or recorded does not have consent
to be observed or recorded commits the offense of
voyeurism.
3. With respect to an image, “capture” means to
videotape, photograph, film, record, by any means, or
broadcast.
4. A private area of an individual corresponds to
the naked or under clad genitals, pubic area, buttocks,
or female breast of that individual.
Prohibited acts
A person who commits voyeurism is punishable if he/she:
1. Prints, copies, publish, distributes, circulates,
sells, advertises the recording.
2. Possesses the recording with an intention of
printing, copying, publishing, distributing,
circulating, selling or advertising it.
3. Installs equipment, or constructs, or adapts a
structure or a part of a structure, with the intention
of enabling himself or another person to commit the
offense.
Penalties
1. The offender is punishable of imprisonment of not
less than 3 years but not exceeding 7 years and a fine
of not less than 100,000 pesos but not more than 500,000
pesos, or both.
2. If a public officer or employee carries out any
activity which is regarded as voyeurism under an
authority of warrant, he/she is administratively liable.
3. If a juridical person carries out any activity
which is regarded as voyeurism, its license or franchise
shall be automatically be deemed revoked
4. If an alien carries out any activity which is
regarded as voyeurism, he/she shall be subject to
deportation proceedings after serving his/her sentence
and payment of fines.
