1. Can sedition or inciting to sedition be committed by a Filipino citizen residing abroad?

Ans. Sedition can only be committed here. If the seditious acts are committed abroad, then we have
no jurisdiction over the crime

If the seditious libel is committed online, then we can take cognizance of the case . Cybercrime
Prevention Act will apply

2. Is rebellion and insurrection the same?

Ans. Yes insurrection and rebellion are the same

3. Regarding violation against domicile - if papers not constituting crime are not returned
immediately, penalty is higher. Is it considered aggravating circumstance?

Ans. No. It is not aggravating circumstance. Aggravating circumstances are limited to what is
enumerated under Article 14. No circumstance will be considered as aggravating if not found
thereunder. We have special aggravating circusmtances found in other laws like use of unlincensed
firearm in the commission of the crime and quasi recidivsim, but they are not aggravating
circusmtances under Article 14
