1. GENERAL

1.1. COMPOSITION OF PRICE PART

The price part shall contain the Cover Letter of Bid, the Schedule of Prices and Rates shall be
prepared in strict accordance with the structure of the Quotation Forms as enclosed hereof and
sealed separately and independently.

1.2. BID PRICES

Tenderer shall indicate on the appropriate Bid Schedule of Prices based on the LUMP SUM
PRICE of the ITT. The LUMP SUM PRICE shall not include any items beyond the requirement
of the tendering document; otherwise, the offer on such items will not be deducted when
evaluation. Also, the price shall not omit any items required in the tendering document;
otherwise, the highest offer of the same item among the effective bids will be added to the total
bid price. In case of discrepancy between unit price and total, the unit price shall prevail. A bid
without itemized price required shall be considered as non-responsive.
Tenderer shall note that all bidding prices (whether of individual items or in total) shall be
considered as tax (including VAT, GST & Sales Taxes) inclusive and no tax shall be mentioned
separately in the bidding price. Tenderer shall be considered disqualified if the tax is mentioned
separately in the bidding price documents.
Prices quoted by the Tenderer shall be fixed during the Tenderer's performance of the contract
and not subject to variation on any account. A bid submitted with an adjustable price quotation
will be treated as substantially non-responsive and will be rejected.
Tenderer’s price offer shall include, but not limit to:
 Price proposal for the scope of service respond to the service requirements given in this ITT
document.
 Its on-site staff’s accommodation, transportation, catering and security.
 Promotion program, discounts scheme, and/or any other special offers applied to Tenderer’s
bid proposal.

1.3. CONTRACT PRICE

In consideration of the EPC CONTRACTOR properly executing the WORK and observing its
obligations in accordance with the CONTRACT, COMPANY shall compensate the EPC
CONTRACTOR in accordance with the CONTRACT a CONTRACT PRICE as stated in this
Document. The CONTRACT PRICE shall be a lump sum fixed price and be deemed to be full
compensation for all the original WORK executed under the terms and conditions of the
CONTRACT. The CONTRACT PRICE shall be firm and fixed for the duration of the
CONTRACT and can only be changed by issue of a VARIATION from the COMPANY. The
CONTRACT PRICE shall be deemed to provide for all and any fluctuations in the cost of
salaries, wages materials, plant, equipment, consumables, fees, rental, taxes, insurance and all

other costs which may be incurred by the EPC CONTRACTOR necessary for the satisfactory
completion of the WORK.

1.4. UNIT RATES

The unit rates and prices for PERSONNEL and construction equipment shall be fixed and firm
for the duration of the CONTRACT. These unit rates may be utilized at the COMPANY
discretion in the calculation of any VARIATIONS. The unit rates and prices shall be deemed to
provide for any and all fluctuations in the cost of salaries, wages, consumables, fees, rentals
taxes, insurance and all other costs. The EPC CONTRACTOR should also include a schedule of
unit rates for MATERIALS supply and installation.

1.5. DESCRIPTIONS AND REFERENCES

Any description or references contained within this Document shall not limit or qualify, the
scope of WORK set out in SECTION 3 - SCOPE of WORK, and FEED TECHNICAL DATA
PACKAGE.

2. COMPENSATION GENERAL

The CONTRACT PRICE contained herein is deemed to include for all items necessary to
perform the WORK and to fully satisfy the CONTRACTORS obligations under the
CONTRACT.
Any item against which EPC CONTRACTOR has not entered a price in the CONTRACT
PRICE breakdown in this Document will be deemed to have been included elsewhere within the
CONTRACT price contained therein.
Attachment 4A hereto breaks down the WORK against individual cost areas. The total of these
prices will constitute the CONTRACT PRICE.
The descriptions provided against each item in Attachment 4A are for the convenience of EPC
CONTRACTOR in the pricing of the WORK. No claim or submission for additional monies
will be accepted by COMPANY on the grounds of EPC CONTRACTORS failure or inability to
price an item of WORK identifiable from SECTION 3 Scope of Work and FEED TECHNICAL
DATA PACKAGE or other CONTRACT documents, not necessarily specifically identified
herein, or for any item which proves to be required for the safe and proper performance of the
WORK or to satisfy the requirements of any approving authority.
The EPC CONTRACTOR shall include a mark-up which would be applied to any items which
the COMPANY requests the EPC CONTRACTOR to purchase on behalf of the COMPANY.

3. METHOD OF COMPENSATION

The EPC CONTRACTOR shall, subject to other provisions of the CONTRACT, be entitled to
monthly payments based upon progress achieved in completion of the WORKS. Payment shall
be based upon COMPANY certified progress statistics submitted by the EPC CONTRACTOR
in accordance with the progress reporting requirements contained in SECTION 3 PROJECT

MANAGEMENT AND QUALITY MANAGEMENT.
Milestone payments shall be due to the CONTRACT. Each request for payment of a milestone
shall include documentary evidence of the completion of such milestone.

4. UNIT RATES FOR VARIATIONS

VARIATIONS to the CONTRACT PRICE for additions/deletions/deductions to the Scope of


WORK shall be subject to the provisions of the Conditions of Contract. All such VARIATIONS
shall be pro-rated from lump sum prices utilized in the compilation of the CONTRACT PRICE
or, at the option of COMPANY, be valued at the rates and prices set out in Attachments 4A to
4C comprising:
Attachment 4A - Contract Price
Attachment 4B - Schedules of Unit Rates for Personnel
Attachment 4C - Schedules of Unit Rates for Equipment
The CONTRACT PRICE shall be deemed to include the cost of preparation of all
VARIATIONS.
The following lump sum elements of the CONTRACT PRICE shall remain firm and fixed for
the duration of the CONTRACT including any and all VARIATIONS to the WORK: Project
Management & Control; Design Office HSE Management & Supervision; Construction
Management & Supervision; Field Office HSE Management & Supervision; VARIATIONS for
additions/deletions/deductions to the Scope of WORK of value less than US$3,000 shall be
deemed to be included within the CONTRACT PRICE.

5. EXTENSIONS OF TIME

Where the ready for startup date is extended by a VARIATION ORDER, the time related
element shall be applied to extension of Programme in Attachment 4C.

6. ASSESSMENTS AND SURVEYS

The EPC CONTRACTOR shall make all assessments and surveys necessary for determining the
progress and quantity of work to be included in Requests for Payment and the quantity of work
in VARIATIONS. Copies of field notes, computations and other records made by the EPC
CONTRACTOR for the purpose of determining the value of Requests for Payment and
VARIATIONS shall be furnished to COMPANY upon request. The EPC CONTRACTOR shall
notify COMPANY giving 24 hours’ notice of the time such assessments and surveys are to be
made. COMPANY, at its discretion, may arrange to appoint a representative to witness and
verify all such assessments and surveys made by the EPC CONTRACTOR. Assessments,
surveys and computations shall be made in accordance with the provisions of SECTION 3
SCOPE OF WORK and such methods that COMPANY considers commensurate with the class
of WORK to be assessed and evaluated.

(c) The Tenderer shall check the drawing and BOQ carefully if there are some items omitted. Any mistakes in the BOQ or drawing
cannot release the Tenderer’s responsibilities for completing all the work and achieved the function requirements as motioned in the
Scope of Work.
(d) Tenderer shall confirm that the quotation shall be fully meeting all the requirements of Scope of Work.
(e) All training cost shall be included in the Contract Price and no need to quote it separately.

SCHEDULE OF UNIT RATES FOR PERSONNEL

1. Labour Rates

1.1. Preamble

EPC CONTRACTOR shall state below its labour rates upon which the prices in Attachment 4A
are calculated:

EPC CONTRACTOR hourly labour rates shall be the total costs exclusive of head office
overhead and profit and shall include the costs of wages, bonus and incentive payments,
overtime shift premium, holidays with pay, sick pay, insurances, pensions, travelling time and
expenses, fares and transport, allowances and all other emoluments and expenses which EPC
CONTRACTOR may make under National or Local Agreements with Trade Unions, all taxes,
complying with all Government regulations, safety requirements, protective clothing, hand tools
and consumables*.
* "Consumables" are deemed to mean all commodities and materials not forming part of the
PERMANENT WORK but which are required for the performance of the WORK, including
welding consumables.

1.2. Working Hours

EPC CONTRACTOR shall state below its working hours upon which its rates are calculated.

1.1. Preamble

Attachment 4B are calculated.
The EPC CONTRACTORS equipment rates shall be the total daily costs inclusive of overhead
and profit and shall include the costs of complying with all Government regulations, safety
requirements, and consumables*.
* "Consumables" are deemed to mean all commodities and materials not forming part of the
permanent WORK but which are required for the performance of the WORK.
