OF ANTONIO T. MAKAPULOT

I, ANTONIO T. MAKAPULOT, of legal age, Filipino, married, employee

of private company, with postal address in Brgy. Valencia, Ormoc City, Leyte,
after having been duly sworn to in accordance with law, fully conscious that I am
answering the following questions under oath, and that I may face criminal
liability for false testimony or perjury and said judicial affidavit was conducted at
the Law Office of Atty. Claire P. Fuentes, located at Conchita Bldg., Rizal St.,
Ormoc City, which taking was done in English which I clearly speak and
understand and that the other information or requirements of Sec. 3, A.M. 12-8-8-
SC as explained to me by the administering officer, hereby deposes and states as
follows:

PURPOSE

This affidavit of the accused, Antionio T. Makapulot is being offered to

prove the existence of doubt on the charged of attempted homicide against the
accused and deny all allegations against him.

Question 1: Please state your name and other personal circumstances for the
records.

Answer 1: I am Antonio Makapulot y Tomol, 32 years of age, married, and

resides at Brgy. Kasilawan, Makati City.

Question 2: Are you the same Antonio Makapulot, who is charge of this case?

Answer 2: Yes, ma’am.

Question 3: Where were you last July 5, 2019 at about 10 o’clock in the
evening?

Answer 3: I was at my home in Brgy. Kasilawan, Makati City.

Question 4: What happen in your home, if any?

Answer 4: I heard the shout of my nephew calling for help.

Question 5: What is the name of your nephew?

Answer 5: Warren M. Gatcho.

Question 6: What happen next when you heard your nephew shouting, if any?

Answer 6: I went out to check on my nephew?

Question 7: What happen when you check on your nephew?

Answer 7: I saw him running towards our home pursued by several persons.

Question 8: What did you do after?

Answer 8: I immediately intervened to avoid further harm to my nephew.

Question 9: What happen after you intervened?

Answer 9: Few heavily drunk persons who were in the parked motorcab
began attacking me and my nephew.

Question 10: What did you do when they attacked you?

Answer 10: We were defending ourselves against the attack.

Question 11: What happen next, if any?

Answer 11: We heard a burst from a gunfire.

Question 12: What did you do after?

Answer 12: Me and my nephew ran towards our house which is 10 meters
away from the place.

Question 13: Did you know who fire the gun?

Answer 13: No, ma’am

the corresponding answers the affiant/witness gave; and;

2. Neither I nor any other person then present or assisting me coached the
affiant/witness regarding the latter’s answers.
