JUDICIAL AFFIDAVIT

I, Miss A, of legal age, Filipino, single and a resident of Brgy. La Paz, Ayala, Zamboanga
City, Philippines, after having been duly sworn in accordance with law, do hereby depose and
say;

That I am the same and identical person who caused for the execution of this Judicial
Affidavit under the supervision and at the law office of the undersigned counsel with the name
and address stated below;

That I had given my answers on the questions below, under oath, with full consciousness
that I may face criminal liability for any false testimony or perjury;

That the following are the questions asked by the undersigned counsel with
corresponding answers which I had given;

Q1: Please state your name, marital status, residence address, and occupation.
A1: I am Miss A, Single, a resident of Brgy. La Paz, Ayala, Zamboanga City and a Sales
lady.

Q2: Are you the same person filing a case of rape against one Mr. X?
A2: Yes.

Q3: Do you know personally the defendant?

A3: No, but all I know that Mr. X delivers milk at our house.

Q4: How many times did you see Mr. X delivered milk to your house?
A4: I usually see him deliver carabao milk in our house when it is my day off.

Q5: Where were you on September 23, 2019?

A5: I was at home alone. My parents and brother went to the farm before sunrise.

Q6: Can you remember something unusual that happened that day?
A6: Yes.

Q7: What happened that day?

A7: It was my day-off so I woke up at around 6:30 am. Upon waking up I decided to take a
bath first, while I was in the bath I heard a loud knock coming from our front door. At
first, I ignored it but the knocking was persistent and so I went to see who was knocking.

Q8: Were you able to get dress first?

A8: No. I didn’t have time to change because I hurriedly went to the front door to see who
was knocking, so I was only wearing a bath towel wrap around my body.

Q9: What happened next?

A9: When I was in the front door, I didn’t opened it first as I was only wearing a bath towel.
I asked who was it and Mr. X answered saying he was there to deliver the carabao milk.

Q10: Was Mr. X alone?

A10: Yes. He always delivers carabao milk alone.

Q11: What happened next?

A11: When I opened the door, Mr. X immediately entered the house and insisted that I drink
the milk while it’s fresh. At first, I was hesitant to drink the milk because I usually drink
coffee in the morning and I am a little uncomfortable with him because I am only
wearing a bath towel. He kept on insisting that I drink the milk and said that I should
drink it immediately because he needed to go to other houses to make his deliveries. And
because I wanted him to leave as I was feeling uneasy, I went to the kitchen to get an
empty glass and went back to him. He then poured the carabao milk.

Q12: Were you able to finish the whole glass?

A12: No. I only drank half the glass.

Q13: And then?

A13: After drinking the glass of milk I felt dizzy and lost consciousness. Next thing I knew, I
was lying on the floor naked. I just remembered that someone was shaking my body and I
heard loud noises, like someone was crying for help. When I opened my eyes I saw my
brother and our neighbor, Pacundo.

Q14: After waking up, what happened?

A14: My brother wrapped up the towel around me, then I slowly went to my room to get
dressed. While putting on my clothes, there was uneasiness and I felt a pain inside my
vagina.

Q15: Can you describe the pain in your private part?

A15: It was an excruciating pain that I never felt before. Almost felt like it was boxed and
something was inside it.

Q16: What happened next?

A16: My brother asked me why I was lying on the floor unconscious and naked.

Q17: What did you respond?

A17: I told him that I was taking a shower when I heard a loud knock on the door. I then
rushed to see who was it and when I asked who was it, Mr. X answered saying he was
there to deliver carabao milk. He wanted to go inside the house for me to drink the milk. I
told him to wait after I get fully dressed but he said that he was in a hurry because he has
to deliver the milk to other houses. When he was inside the house he was persistent that I
should drink the milk while he was there because it tastes better while fresh. As I was a
little uncomfortable and in order for him to leave, I went to the kitchen to get an empty
glass. He then poured the milk. After drinking the milk, I felt dizzy and lost
consciousness and next thing I knew I was lying on the floor naked. I also told him that
when I regained my consciousness, I felt a pain inside my vagina.

Q18: What was your brother’s reaction?

A18: He was mad and told me to prepare so that we could immediately report the incident to
the police.

Q19: What happened then?

A19: My brother and I went to Ayala Police Station to report the incident.

Q20: What did the police men do?

A20: The police catered us. After telling what happened, they begun the investigation and
advised that I should be physically examined.

Q21: What happened after that?

A21: We went to Zamboanga City Medical Center for a physical exam which was conducted
by the Medico-Legal Officer and my blood sample was also taken as per her instructions.

Q22: Do you have anything else to say Ms. A regarding the incident?
A22: I have nothing more to say.

regarding the latter’s answer.
