CASE REPORT
OFFENSE : RA 8353 (RAPE)

COMPLAINANT : MISS A, 26 years old, single, sales lady, residing at Ayala,

Zamboanga City

SUBJECT : MR. X, 30years old, single, residing at Recodo, Zamboanga City

DATE/TIME/PI : Sometimes on September 23, 2019 at Ayala, Zamboanga City

DATE REPORTED: September 23, 2019 at 1:00 PM

REFERENCE: IRF Number 2019-0123 dated September 23, 2019.

Above named complainant accompanied by her family arrived at this station

to file a complaint against Mr. X for the crime of Rape under RA 8353 Amending for the
purpose Act No. 3815, otherwise known as The Revised Penal Code, and for other
purposes.

Investigation conducted that in the morning of September 23, 2019 (Monday)

at around 6:30 AM after waking up late, Miss A was left alone in their house because
her parents as well as her brother were already out in the farm. She went to the
bathroom to take a bath, when she was about to finish, she heard a loud knock on their
front door, she ignored it at first, but since the knocking was persistent, she decided to
check it out.

At around 7:00 AM, with a bath towel wrapped around her, she proceeded to
the front door. She inquired who is knocking to which a man replied known to them as
Mr. X. He regularly delivers Carabao’s milk contained in a bottle with cap. He requested
to be allowed to enter to deliver the milk because he was in a hurry.

Miss A denied and told him to wait as she would just dress up but Mr. X was
insisting that he will just leave the milk. When Miss A opened the door, Mr. X
immediately entered the house, while inside, he asked Miss A to taste the milk insisting
that it’s best to drink it while it’s fresh. To get it over with, Miss A took an empty glass
and Mr. X poured a glassful of milk. Miss A consumed more than half the glass and
explained that after drinking, she immediately felt dizzy and eventually lost
consciousness.

Meanwhile, across the house of the Complainant is a sari-sari store owned by

Paolo Pacundo who were in front of his store cleaning and sweeping the leaves out. Mr.
Pacundo states that he is familiar to almost everybody in his neighborhood even to Mr.
X who delivers milk to his store daily.

At around 7:00 AM of September 23, 2019, Pacundo noticed Mr. X knocking

at the door of Miss A. To his surprise, at about 7:30 AM as he was cleaning outside
while listening to his favorite radio station, Mr. X left the house of Miss A in a hurry while

fixing himself and buttoning his trousers and ignored his call when it is already his turn
to be delivered the glasses of milk. Although Pacundo was surprised, he still continued
attending his store.

At around 9:00 AM of the same date, the brother of Miss A arrived; he noticed
that the door was not locked when it should have been locked by her sister (Miss A)
upon leaving for work. He rushed inside and saw her sister naked on the floor. He
shouted for help and Pacundo who were just in close proximity headed the call.

Miss A woke up due to the rough shaking on her shoulders and upon opening
her eyes; she saw her brother and Pacundo. She was rushed to the hospital due to
body pain including her private part.

Acting on this report, the undersigned investigator made a request for

medico-legal examination for the victim including the Toxicology exam for the milk.
Afterwards complainant willfully executed her sworn statement, judicial affidavit to form
part on the papers being readied for the filing of formal charges against subject person
MR. X, 30 years old, a resident of Recodo, this city.
