JUDICIAL AFFIDAVIT OF SPO4 DENIEL BUENO

PRELIMINARY STATEMENT

The person examining me is Prosecutor JASONRY BOLONGAITA of the Provincial


Prosecutor’s Office, Tagbilaran City and this judicial affidavit is being taken at such office. The
questions are asked in the English language and I am giving my answers fully conscious that I do
so under oath and I am aware that I may face criminal liability for false testimony or perjury for
false statements made or given by me.

OFFER OF TESTIMONY

The testimony of the witness SPO4 Deniel Bueno is being offered to prove that:

1. The Philippine National Police Station at Poblacion, Sierra Bullones, Bohol received an
anonymous call that a dead body of man lying in a pool of blood was found in a deserted
area of Brgy. Bugsok, Sierra Bullones, Bohol;

2. The station commander immediately ordered to conduct an ocular inspection and


investigate the matters subject of the emergency call;

3. In compliance with said order, SPO4 Bueno along with two other officers went to said
place of the alleged incident to investigate, and;

4. Certain pieces of evidence and other facts in relation to the investigation that was
conducted by said police officers.
1. Q: Mr. Witness, will you please tell the Honorable Court your name, age and other personal
circumstances?

A: I am SPO4 Deniel Bueno, 45 years of age, a police investigator stationed at Sierra


Bullones Police Station.

2. Q: How long have you been a police investigator?

A: More than ten years already.

3. Q: How long have you been stationed in Sierra Bullones?

A: I have been there for more than two years now.

4. Q: What do you remember on the tenth day of December, 2018?

A: When I was on duty at the police station, at around five o’clock in the morning, an
anonymous call confronted our office.

5. Q: Who answered the phone call?

A: It was yours truly.

6. Q: What was the subject of that call?

A: The caller reported to us that a dead body of a man in a pool of blood was found in a
deserted area in Brgy. Bugsok, Sierra Bullones.

7. Q: What did you do after the phone call?

A: I immediately relayed the information to our station commander who happened to be in


the station at that time.

8. Q: What was then the response of your commander?

A: Our commander instructed me together with PO1 Philip Morris and PO2 Darlene
Karaan to respond to the area to confirm the report and to conduct investigation.

9. Q: Upon arrival at the reported crime scene, what did you see?

A: There was a crowd of people surrounding a dead body of a man in a bloodbath.

10. Q: How are you certain that the man was already dead?

A: We have consulted a medic team who have also responded to the incident and they
confirmed that the man was dead before our arrival in the area.
11. Q: What did you do after learning that the man was already dead?

A: We have surveyed the area, conducted investigation and asked some folks there to
extract valuable information.

12. Q: What did you find on the crime scene?

A: Beside the body was a bolo with lots of blood in it. We believe that such was the
weapon used by the culprit in killing the victim.

13. Q: Were you able to know the owner of that bolo?

A: No one on the area knew who is the owner of it.

14. Q: I am showing you a picture, do you recognize it?

A: Yes. it's the bolo we found on the crime scene.

15. Q: How can you say so?

A: I can see the initials of my name I have encrypted on it before I put the same in the
plastic bag.

The same picture as part of evidence is marked as Annex A and deemed part of this affidavit.

16. Q: What did you observe on the area of the crime scene?

A: The area was deserted. Although it was near the rice fields, tall grasses and plants
have overwhelmed the area and there were no houses nearby.

17. Q: Have you talked to some witnesses?

A: A certain folk in the name of Vicente Engbino approached us and narrated that the
victim was able to communicate to him the identity of the attacker.

18. Q: What did he tell you?

A: He told us that when the victim was gasping for breath and clearly in the dying state,
the victim ordered him to come closer and there he confessed that a certain Julio Quieta
hacked him several times.

19. Q: What other information did the witness tell you?

A: He further narrated to us that he knew personally the victim as well as the alleged
culprit as they are neighbors.
20. Q: What did you do after you have received the information?

A: We have invited the alleged suspect to come over to the station for some questioning
in relation to the incident but he refused for no reason at all.

21. Q: What did you do next?

A: We have relied on the testimony of the lone witness and secured a warrant of arrest
against the herein accused.

22. Q: What about the corpse?

A: The corpse of the victim was turned over to the medico legal office for further
investigation.

other person or persons then present or assisting the witness regarding the latter’s answers.
