A: May I proceed with the direct examination your honor

P: With the kind permission of the Honorable Court, the testimony of the witness is being offered to
prove or corroborate with the testimony of the accused that on or about 5:30 pm of October 9, 2021,
Christian sevilla y Cabrera was murdered by vicmar gullab y balasta, Renato. Almario y nolia, joel
sumaliling y Solomon. The testimony will also prove on all other matters which may be relevant to
the case. May the counsel proceed Your Honor?

J: proceed

P: Mr. Witness, why are you here in Court ?

L: I am here because I received a subpoena in the case of ----- as the investigator of the case.

P: so you are the investigator of this case, correct?

L: yes.

P: Can you state in this court who are the accused of this case?

L: Your honor may I ask permission from the honorable court if I can get my notes?

J: -----

P: who again are the accused of this case?

L: The accused are Vicmar Gulab y Balasta, Renato Almaro y Nolia and Joel Sumalilin y Solomon.

P: According to the documents there are three accused. Now, in relation to this, being the
investigator of this case, do you recall having executed any document?

L: I have executed my judicial affidavit/Sinumpaang Salaysay and my Investigation Report.

P: If the same is shown to you, will you be able to identify it?

W: Yes

P: Your Honor, may I approach the witness?

J: You may go

P: I am showing to you this Judicial Affidavit. What is the relationship of these documents to the
documents that you said you have executed?

W: One and the same.

P: I am showing to you this Judicial Affidavit and there appears to be a name and a signature on top
of it. Whose name and signature is this?

W: That is my name and signature

P: Do you confirm and affirm the veracity and truthfulness of all the allegations contained in your
Affidavit?

L: Yes

P: At this juncture your Honor, we would like to mark the Judicial Affidavit as Exhibit B and we pray
that the signature of PAT NESTOR V ARIZ be marked as Exhibit B-1.

P: Your Honor, We are adopting the Judicial Affidavit of our witness to form part of his direct

CROSS EXAMINATION

D: How was witness Joel Bajao discovered?

L: The witness reported the crime to the barangay and it was the barangay official who
reported to the police station

D: Why did the accused not charged as the principal?

L: Your Honor, we charged the confessant as one of the principal of the murder case. However,
your honor, it was the fiscal who downgraded the charge to an accessory of the case.
