Section 5, Article II of Republic Act 9165, Sale, Trading, Administration, Dispensation, Delivery, Distribution
and Transportation of Dangerous Drugs and/or Controlled Precursors and Essential Chemicals.

My name is Jake Zyrus. I live in Espana, Manila. I finished Bachelor in Criminology. I am presently working
as a police officer stationed in Espana Police Station, Manila.

Your Honor, we are offering the testimony of this witness to prove the genuineness and due execution of th
seizure receipt; to identify the accused in this case and likewise to identify some documents to this case an
to testify on such other matters as may be relevant, Your Honor. With the permission of the Honorable

Madam witness, as mentioned in your Judicial Affidavit, you are one of the arresting officers who arrested
the accused in the person of Alexa Dela Cueva, is that correct?

Can you tell us why you personally know Ms. Alexa Dela Cueva
I am the one who personally arrested her during the buy-bust operation, Atty.

How did you know that Ms. Alexa dela Cueva was involved in the selling of illegal drugs locally known as
“shabu”?
Days prior to the operation, a concerned citizen personally appeared before our office and reported to our
Team Leader (PCPT MAGDALENA) regarding the involvement of the subject in illegal drug activity.
What did you do upon receiving the said information?
Our team leader directed one of our Intel Operatives to conduct a validation in order to confirm the veracity
of the information.
What was the result of the validation made by your Intel Operative?
It was confirmed that the subject was indeed engaged in selling illegal drugs, further, we got the subject’s
identity and her way of selling illegal drugs.
When did you conducted the buy-bust operation?
On February 15, 2023 at around 6:00pm, Atty.
Where did you conducted the buy-bust operation?
In the residence of Ms. Alexa Dela Cueva, Atty. Near Sto. Domingo Church.
During the buy-bust operation, did you personally see that Ms. Dela Cueva was indeed selling dangerous
drugs?

What dangerous drugs were you able to see during the buy-bust operation?
It was a shabu, Atty.

We found two transparent heat-sealed sachets containing white crystalline granules, Atty.

The specimen consists of two heat sealed transparent plastic sachet containing suspected shabu marked
BB-ROD-7-21-2020 and PB-RRJ-7-21-2020, respectively.
Did the specimen yielded a positive result to the tests for Methamphetamine Hydrochloride which is a
dangerous drug under RA 9165?
Yes, Atty.
I have here the Chemistry Report No. D-1097-23-RDU3-B which was marked as Exhibit L. Can you confirm
if this is the one that you made showing a positive result for the specimen which was seized from the
accused during the buy-bust operation? (shows the chemistry report to Dra. Garcia)

Barangay Captain of Barangay 586, Sampaloc, Manila.

able to witness the arrest and the making of the inventory of the seized illegal drugs and to testify on such
other matters as may be relevant, Your Honor. With the permission of the Honorable Court, may we

Honorable Extrada, where were you on February 15, 2023 at around 6:00 pm?
I am staying in my house, Ma’am.
Did you know of any buy-bust operation to be conducted by the police in your barangay?
Yes, Ma’am.
How did you know that there will be a buy-bust operation during that day?
Because I was informed by SPO2 Zyrus and I even attended the preoperation meeting together with the
buy-bust team, the DOJ representative and a media representative.
Did you personally see how Ms. Dela Cueva was arrested by the police officers?
No, Ma’am.
Why were you not able to see the arrest of Ms. Dela Cueva?
Because I was late and when I went to the Police Station, SPO2 Zyrus just handed over to me the Inventor
Report and asked me to sign it.
So, you mean, you signed the Inventory Report without witnessing the whole operation?
Yes, Ma’am.
For the record, Honorable Karla Extrada signed the Inventory Report without witnessing the whole
