AFFIDAVIT OF REAPPEARANCE OF ABSENTEE SPOUSE

I, Pah Ugtas, of legal age, Filipino citizen, a resident of Rosero St.,
Brgy. Kalipay, Masbate City, and at the time of the foregoing incidents, is
currently married to Maria Ugtas, also a resident of Rosero St., Brgy.
Kalipay, Masbate City, for ten (11) years celebrated on March 3, 2010, after
having been duly sworn on oath in accordance with the law, hereby
voluntarily depose and state that:
1. I am an Filipino seafarer working for the interest of MAKAI Shipping,
with principal address at Manila, engaged in the business of
transporting liquefied natural Gas domestically;

2. I have been employed by MAKAI Shipping for almost fourteen (14)

years;

3. I am assigned as the Chief Engineer of MAKAI Shipping.

4. On the 17th day of Septmeber 2013, we are bound to Mindanao,16

hours later afte the departure, while we were sailing in the deep
waters of Sulu Sea, we were caught up in a strong hurricane storm
surge that caused the ship vessel to capsize and caused us fear,
panic, and I lost consciousness as something bump my head;

5. Thereafter, I woke up in pain in an uninhabited island without

knowledge as to how did I get there and started to look for people to
ask for help, but to no avail no sign of human population is to be
found,

6. I have exhausted all possible means looking for help.

7. I started to treat my injury, search for food to eat and a place to stay
during night and it last for a long period of time without any sign of
help;

8. After 9 years without losing hope that someone would rescue me. I
was able to see a fisherman boat and called their attention and
thereafter I was rescued and freed from that island.
 9. I was sent to the hospital for my checkup, I learned that I have spent
there for a period long enough to missed nine celebrations of
Christmas;

10. To my dismay, instead of expecting my lovely wife to come and

reunite with me whom I have missed so much, I learned that she
contracted another marriage with Jose Yemen, celebrated in
Masbate City.

11. I am executing this statement to attest to the above mentioned facts

of my disappearance and reappearance and to terminate said
subsequent marriage in compliance with Article 42 of the Family
Code.

IN TRUTH WHEREOF, I have hereunto signed my name below, this
