MOTION TO SUSPEND OR HELD IN ABEYANCE

PROCEEDINGS

COMES NOW, ACCUSED through counsel and to this

Honorable Court, most respectfully manifest and move that:

1.Accused is being charged with the crime of Libel as

defined in Art. 353 of the Revised Penal Code;

2.Accused has filed a petition for review appealing the

resolution of the Prosecutors Office to the Department of
Justice, attached is the copy of the petition as Annex “A” of the
motion;

3.In accordance with the rules, Accused begs the

indulgence of the Honorable Court to suspend further
proceedings for a period allowed by the rules in order for the
appeal to be considered by the Department of Justice;

4.The instant motion is not intended to delay the

proceedings only for reason above-cited to allow the appeal to
be resolved.

PRAYER

WHEREFORE, premises considered, it is most

respectfully prayed that the instant motion be granted and
further proceedings in this case be held in abeyance for a period
allowed by the rules pending the resolution of the appeal by way
of petition for review to the Department of Justice.

Accused prays for such other relief and remedies proper

in the premises.
