AFFIDAVIT OF ADVERSE CLAIM
         I, LUIS ORTEGA, of legal age, Filipino, and a resident of Barangay Sambag, Bogo City,
after having been duly sworn in accordance with law, depose and state:

1. That I, through a Special Power of Attorney hereto attached, am authorized by the Heirs of
Pedro Jugan to execute this affidavit of adverse claim.

2. That the late Pedro Jugan was a co-owner of a parcel of land then known as Lot No. 16001,
together with other five (5) co-owners. It is located in Luyang, San Remigio, Cebu and has an
area of 20, 115.50 square meter, more or less.

3. That the said lot is now divided into three parcels: Lot No. 16001, 16002, and 16070 when
roads were constructed crossing the original parcel.

4. That sometime in year 1950 the other co-owners led by Rufino Jugan donated Lot No.
16001 to the Municipality of San Remigio “for school purposes only.” The donation was
made without the participation of Pedro Jugan.

5. That the donee in that donation utilized only 3,940 square meters of the entire donated land
and all situated in the present Lot No. 16001; Lot No. 16002 is now occupied by illegal
settlers, while Lot No. 16070 is totally vacant and unutilized.

6. That Lot No 16070 should be returned to the Heirs of Pedro Jugan for not having
participated or consented to the said donation and on the further ground that Lot No.
16070, which stretches from the highway to the shoreline, has never been utilized for
school purposes.

7. That in behalf of the Heirs of the Late Pedro Jugan, I am executing this Affidavit for the
purpose of attesting to the truthfulness of the foregoing allegations and in support of my
request for the annotation of an adverse claim over the parcel of land known as Lot No
16070 in its existing tax declaration.

     IN WITNESS WHEREOF, I have hereunto set my hand this 8th day of March 2019 in San
Remigio, Cebu, Philippines.
