INTRODUCTION

The case “The state of Tripura Vs. Smt. Bibhu Kumari Devi” is a case related to land dispute
of Nirmahal and RudraSagar regarding the Possession of the property between the state of
Tripura and Bibhu Kumari devi. Initially, the lower court had passed an order in favour of Bibhu
Kumari who was a Plaintiff in this case. Later, On The Tripura High Court has overruled the
judgement of lower Court. It deals with the provisions of Code of civil procedure, 1908 ;
Tripura land revenue and Land reforms Act ,1960 ; Transfer of Property Act, 1882 ; The
Constitution of India, 1950. The said case deals with the provision of Sec 79 of CPC which
defines “Suits by or against Government” and Order 27 of CPC, 1908.

The Provisions are as follows :-

3. Part IV , Sec. 79 , 80 of CPC.
4. Order 27 of CPC.
5. Sec. 5 of Transfer of Property Act , 1882
6. Sec. 107 of Tripura Land Revenue and Land Reforms Act , 1960
7. Article 153 of Constitution of India, 1950

Aims and Objectives :


The Researcher aims to fulfill below objectives through this project :

1. The main aim of this project is to know about the provisions of Civil Procedure Code dealt in
the give case.

2. To know about the facts and judgements of the Case.

3. To know the different Orders with the Rules and their effect in the Final Judgement .
Research Methodology
The Researcher will be relying on Doctrinal method of research to complete this project.
