COMPLAINT

COMES NOW the plaintiff by the undersigned attorney, and unto this Honorable Court,
respectfully alleges:

1. That plaintiff is of legal age with residence at ____________address_______,


and defendant’s identity and address are unknown to plaintiff at present.

2. That, on ____dated_____, in _____place___________, Philippines, defendant


while driving a taxi with plate Number _______, did then and there, through
recklessness and imprudence, hit plaintiff's tricycle, with plate Number _______,
while said tricycle was parked at ______________________St, infront of a poker
house, thereby smashing the entire tricycle and seriously damaging the entire
tricycle, as a result of which plaintiff suffered damages in the amount
Php___________.

3. That defendant sped away after hitting plaintiff's tricycle, rendering it impossible
for plaintiff to get the name of the said defendant, but plaintiff did succeed in
identifying the make and color of defendant's taxi, as well as the number of the
same.

WHEREFORE, it is prayed that judgement issue ordering defendant, as soon as his


identity is ascertained, to pay to plaintiff the sum of Php____________ plus costs.
