REGISTRATION OF QUANTITY SURVEYORS ACT 1967 ‘NOTIFICATION IN exercise of the powers conferred by section 4 (d) of the Registration of Quantity Surveyors Act 1967, the Board of Quantity Surveyors, with the approval of the Minister, fixes the scale of fees to be charged by registered ‘quantity surveyors for professional advice or service rendered: 1, Every consulting quantity surveyor who is engaged by a client to perform any of the professional services described in Part A shall be paid in accordance with the scale of fees described in Part B. 2. In this notification, unless the context otherwise requires:— “consulting quantity surveyors” means the quantity surveyor engaged by the client to perform the professional services ; “contractor” means any person or persons, firm or company under a contract with the client to perform the work or to supply goods in connection with the works or bath and includes a sub-contractor; “cost of works” means the total cost to the client, however incurred, of all builders’, specialists’ or sub- contractors’ works, services, installations and equipment designed, specified or allowed for and forming an integral part of the total project to enable it to function fully and occupied up to its intended standards of comfort, convenience, décor and finishes (before deduction of any liquidated damages or penalties payable by the contractor to the client) and including a fair valuation of any labour, materials, manufactured goods, machinery or other facilities provided by the client, and of the full benefit accruing to the contractor from the use of construction plant and equipment belonging to the client which the client has required to be used in the execution of the works, the market value as if purchased new, of any second-hand materials, manufactured goods and machinery incorporated in the works and price variations arising from escalation of prices; but shall not include the value of operating equipment or machinery that are not an integral or essential part of the building, administrative expenses, costs incurred by the client under the agreement between the client and the consulting quantity surveyor, interest on capital employed during construction and the cost of raising moneys required for carrying out the construction of the works, and the cost of land and way- leaves. The cost of works shall be arrived at as follows: — (1) for completed works, the total final cost of all works including variations or the original contract sum less contingency sum whichever is the greater; (2) for works tendered but not awarded, the lowest acceptable tender received less contingency sum, and prime cost and provisional sums for which no measurements have been done, and (3) for works where tenders have not been received, the latest estimate of costs prepared by the consulting quantity surveyor which has been submitted and agree to by both the client and the consulting quantity surveyor. PART A PROFESSIONAL SERVICES 1, TYPES OF PROFESSIONAL SERVICES. ‘The Professional services to be provided by the consulting quantity surveyor shall be as follows — (a) _ basic services for building and civil engineering works; and (b) additional services. 2. BASIC SERVICES FOR BUILDING AND CIVIL ENGINEERING WORKS ‘The basic services for building and civil engineering works to be provided by the consulting quantity surveyor shall be as follows:— (2) preparation ot preuminary estimates and cost plans; (0) preparation of bills of quantities and other tender documents; (©) preparation of tender reports and contract documents; (4) preparation of tender documents, tender reports and contract documents for prime cost and provisional sum items other than those under the charge of mechanical and electrical engineering consultants; W/l0 (s) valuation of works in progress for interim valuations/certificates including variations; and (f) preparation of final accounts, ADDITIONAL SERVICES The additional services to be provided by the consulting quantity surveyor shall be as follows: — (a) _ preparation of feasibility studies including income/expenditure cash flow; (b) _ preparation of final costs for contracts based on provisional bills of quantities; (© pricing of bills of quantities or pricing and agreeing schedule of rates; (d)_remeasurement of the whole or part of the building works due to re-planning of the internal layout arising from a change of use, repositioning of the building (if remeasurement is required), and redesigning of any of the structural element in the works; (©) _ preparation and attendance for arbitration/litigation; and (© preparation of documents and reports for prequalification of contractors. CATEGORIES OF PROJECT (@) For the purpose of calculating the fees for basic services for building and civil engineering works, projects are classified as follows:— (Building Works:— Category A Detached and semi-detached houses, terrace and link houses, cluster houses, shophouses and flats (not exceeding 4% storeys) Category B_ Flats (over 414 storeys), maisonettes, condominiums, multi-storeys carparks, hangers, warehouses, factories, army camps and barracks, hostels, schools, petrol service station, markets, bakeries, fire stations, laundries, packing and processing plants, banks, office buildings, libraries, hospitals and nursing homes, sports complexes, laboratories, airport terminals and ancillary buildings, halls (all types), university and college buildings, hotels, motels, abbatoirs, crematoriums, commercial complexes, cinemas, theatres, prisons, museums, court houses, bowling alleys, breweries, cold storage buildings, health centres, restaurants, skating rinks, indivic lually designed houses, private clubs, transportation terminal buildings, mosques, churches, temples, palaces, mausoleums, memorials, monuments, research buildings, observatories and marinas, and other buildings of exceptional character and complexity. Category C Extensions, alterations, restoration and associated demolition works. (ii) Civil Engineering Works: Category A General civil engineering works such as roads, drains, earthworks, water reticulation and other related works. Category B Reinforced concrete works, structural steel works and buildings forming part of civil engineering contracts such as bridges, jetties, ports and other related works. (0) In determining the categories of building works in paragraph (a) (i), the following guidelines shall be taken into account; — (for the purpose of categorising of works, demolition and piling works forming part of any development or construction, shall be considered as part and parcel of a project of the respective category; (ii) infrastructural works under Category A (building works category) is considered building works but works outside the boundary lot of each unit of building shall be treated separately under civil engineering works; ii) infrastructural and external works within the scope of the building contract in Categories Band C shall be considered as part and parcel of the respective building works; and W/IL (©) for the purpose of arriving at the cost of a repetitive unit, the following guidelines shall be taken into account:— (i) the cost of a single unit shall be computed by including the total cost of all the builder's ‘works, built-in fittings, integral services and installations, site and external works and other services serving the immediate site on which the units are constructed for all units that are repeated and dividing it by the total number of repeated units; (ii) a pair of semi-detached houses shall be considered as two units; (iii) @ unit in row of terrace houses shall be considered as one design but the end unit ina row of terrace houses shall be considered as another design; (iv) a block of flats shall be considered as a single unit; and (v) the handing of plans (mirror image) of otherwise identical type plans of a standard unit shall be considered as one unit. If no measurement is required, a reduction of 1/3 of the cost of the mechanical and/or electrical ‘engineering work shall be made for the cost of works in calculating the fees of the consulting quantity surveyor, provided that in any event, the total fees of the consulting quantity surveyor shall not be reduced by more than 1/6 of the total fees. W/i4 (©) Where there is more than one unit of the sume design in all respects, the fees shall be as follows: — Building Unit Fees Payable For the original unit 100%6 (full fees) For the 2nd unit 65% of full fees For the 3rd unit 5596 of full fees For the 4th unit 45% of Full fees For the Sth and subsequent units ‘40% of full fees 2. SCALE OF FEES FOR BASIC SERVICES WHERE CONTRACTS ARE BASED ON PROVISIONAL BILLS OF QUANTITIES Where contracts for building works are based on provisional bills of quantities, the fees for services rendered under any of the categories of work in paragraph 1 (a) (i) shall be increased by 35%. 3. PERCENTAGE BREAKDOWN OF FEES (@) The percentage of fees payable to the consulting quantity surveyors for every stage of the services shall be as follows: — Type of Contracts Stages of Services Building and civil (@ Preparation of preliminary estimates and cost plans 10% engineering works (ii) Preparation of bills of quantities and other tender 50% documents (excluding preparation of tender documents under item (iv)) Gil) Preparation of tender reports and contract documents % (iv) Preparation of tender documents, tender reports and 5% contract documents for prime cost and provisional sum items other than those under the charge of mechanical and electrical engineering consultants (¥) Valuation of works in progress for interim valuations/ 15% certificates including variations (vi) Preparation of final accounts 15% —- TOTAL SERVICES 100% —.W. (0) The consulting quantity surveyor shall be paid the proportion of fees stipulated above for the services provided within each stage or the full amount upon satisfactary completion of each stage. 4. SCALE OF FEES FOR ADDITIONAL SERVICES The fees payable to the consulting quantity surveyor for additional services shall be as follows:-— CC ‘Type of Services Fees Payable (a) Preparation of feasibility studies including Time basis/fées to be negotiated income expenditure cash flow —_).]7S (b) Preparation of final costs for contracts Overall fees for all categories of projects shall based on provisional bills of quantities be increased by 35% of the fees for the preparation of bills of quantities —. FEES FOR ATTENDING MEETING BEYOND THE CONTRACT PERIOD The fees for attending meetings in connection with or arising out of the works beyond the original contracted date of completion and any approved extension of time shall be calculated as follows:— Basi salary per month 173 hours per month 6. REIMBURSABLE EXPENSES: In addition to the fees payable to the consulting quantity surveyor for any of the services provided, Multiplying factor agreed by the client and the consulting quantity surveyor the consulting quantity surveyor shall also be entitled to be reimbursed for certain expenses actually incurred by the consulting quantity surveyor towards the completion of the project. The expenses to be allowed are as follaws:— Reimbursable Payable (i) Travelling expenses (if exceeding 10 km. from Chargeable according to current rates applicable the address of main office/branch office) to Government Officers in the Superscale *G' category ‘Type of Expenses (ii) Accommodation and Jodging allowances (if exceeding 80 km. from the address of main office/branch office) Chargeable according to current rates applicable to Government Officers in the Superscale *G’ category Based on current rates agreed by the client and the consulting quantity surveyor (iil) Lithography expenses W/16 (iv) Advertisement of tender notices, telegrams, ‘Actual amount telexes and out-stations telephone calls (¥) Resident quantity surveyor who is required Basic Multiplying factor to be stationed on site salary agreed by the client "et month x and the consulting Tisteem - quantty suneyor per month 7. TIME OF PAYMENT FOR SERVICES RENDERED (a) Basic Services:— Payment of fees for services provided shall be made at monthly, bimonthly or trimonthly intervals in proportion to the services rendered so that the total fees paid at the completion of each stage of service shall be equal to the breakdown of percentage charges in paragraph 3 of this Part. (b) Additional Services:— ‘The consulting quantity surveyor shall be paid the proportion of fees for the services provided within each stage ot the full amount upon satisfactory completion of each stage in accordance with paragraph 4 of this Part 8. TIME OF PAYMENT FOR REIMBURSABLE EXPENSES: Payment of reimbursable expenses shall be made upon submission of bills by the consulting quantity surveyor, 9. PAYMENT FOR REMEASUREMENT OF WORKS DUE TO ALTERATION OR MODIFICATION OF DESIGN If after the completion by the consulting quantity surveyor of his basic services under paragraph 2 of Part A at any time after execution of an agreement between the client and the consulting quantity surveyor, any measyrement whether completed or in progress or any specification or other document prepared in whole or in part’by the consulting quantity surveyor is required to be modified or revised by reason of instructions received by the consulting quantity surveyor from the elient or others acting on behalf of the client, or by reason of circumstances which could not reasonably have been foreseen by the consulting quantity surveyor, the consulting quantity surveyor shall be paid an additional payment by the client for making any necessary. modification or revision and for any consequential reproduction of documents and the fees due shall be based on paragraph 3 (a) (ii) of this Part, which is S0% of the gross value of measured omissions and gross. Yalue of measured additions, both gross values added to the cost of works to calculate the fees provided that such modification or revision shall be limited to the following:— (@)_remeasurement of the whole or part of the building works due to replanning of the internal layout arising from a change of use or repositioning of the building (if remeasurement is required); and/or () redesigning of any of the structural elements in the works. 10. PAYMENT WHEN WORKS ARE DAMAGED OR DESTROYED If at any time either during the execution of the works or before the commencement of the defects liability period/period of maintenance, any part of the works or any materials, plant or equipment whether incorporated in the works or not shall be damaged or destroyed by any cause other than the negligence on the part of the consulting quantity surveyor, the consulting quantity surveyor shall be paid an additional payment ‘in respect of any expenses incurred or additional work required by the client to be carried out by the consulting ‘quantity surveyor as a result of such damage or destruction. 11. PAYMENT FOLLOWING TERMINATION OR SUSPENSION BY THE CLIENT. (@) In the event of the termination of this agreement (unless such termination shall have been ‘occasioned by the default of the consulting quantity surveyor) or the suspension of the project by the client, the consulting quantity surveyor shall be paid in accordance with the percentage of breakdown of fees stipulated under paragraph 3 of this Part except that payment for any uncompleted stage of the consulting quantity surveyor's services shall be on the basis of quantum meruit. WilF (b) In the event that the consulting quantity surveyor is required to recommence the project after the project has been suspended by the client for more than twelve (12) months, the consulting quantity surveyor shall be paid fees based on the new total cost of uncompleted works.
