TERMS AND CONDITIONS

FOR CASHU SAVINGS PROGRAM

These Terms and Conditions outline the rules and regulations for the use of CASHU Savings Program.

By accessing this service, we assume you accept these Terms and Conditions in full. Do not continue to
use CASHU Savings Program if you do not accept all of the Terms and Conditions stated on this page.

1. Terminology

The following terminology applies to these Terms and Conditions:

- “Customer”, “You” and “Your” refers to you, the person accessing this service and accepting
these Terms and Conditions.

- “CASHU”, “The Company”, “Ourselves”, “We”, “Our” and “Us” refers to FENTECHLINE PTE
LTD; a company incorporated in Singapore, holding CASHU Stored Value Facility and
operating under the Monetary Authority of Singapore (MAS).

- “Party” or “Parties” refers to both the Customer and CASHU, or either the Customer or
CASHU.

- “Account” refers to the personal online account that the Customer is allocated on
registration on CASHU, which holds electronic money for use in online transactions.

- “Service” refers to CASHU Savings Program available on the website www.cashu.com and
its related sub-domains, sites, services, tools and mobile application.

- “Deposit Certificate” refers to a savings certificate with a fixed maturity date and specified
fixed amount, which can be issued through the Savings Program inside CASHU Accounts.

- “Cycle” refers to the period of time the Customer wants to keep his/her Deposit Certificate
locked up until he/she can start earning profit. Cycles include 3, 6, 9 and 12 months.

- “Profit” refers to the extra funds the Customer may get on his/her Deposit Certificate after
it matures. Profit can be up to 5% every Cycle.

- “Maturity Date” refers to the end of a Deposit Certificate Cycle.

Any use of the above terminology or other words in the singular, plural, capitalization and/or
he/she or they, are taken as interchangeable and therefore as referring to same.

2. Description of Service

1.1. CASHU Savings Program is part of CASHU services that are available on the website
www.cashu.com and its related sub-domains, sites, services, tools and mobile
application.

1.2. CASHU Savings Program enables Customers to buy Deposit Certificates as promissory
notes issued by CASHU.

1.3. At the end of a Cycle, the Deposit Certificate matures, and the entire amount of the
Deposit Certificate, as well as any earned profit, is available for refund.

1.4. As the Customer approaches the end of the Cycle, CASHU notifies him/her that his/her
Deposit Certificate is about to mature and give him/her several options. If the Customer
does nothing, his/her Deposit Certificate will be kept for another Cycle.

1.5. The longer the Customer keeps his/her Deposit Certificate, CASHU rewards him/her and
agrees to pay him/her higher annual profit; up to 25% on the funds he/she deposits.

1.6. When the Customer buys his/her first Deposit Certificate, CASHU will reward him/her
with a 5% bonus on his/her Deposit Certificate amount, which will be credited to the
Customer’s Account.

3. Cancellation

The Customer has the option to cancel a Deposit Certificate and refund his/her money back to
his/her Account at any time, even prior the maturity date.

If the cancellation happens prior to the maturity date, an Early Cancellation Fee of USD 1.00 will
apply and be deducted from the cancelled Deposit Certificate amount on refund.

If the Customer got a 5% bonus on his/her first Deposit Certificate that he wants to cancel prior
the maturity date, the amount of the bonus will also be deducted from the cancelled Deposit
Certificate amount on refund.

If the cancellation happens after to the maturity date, no cancellation fee will apply.

4. Withdrawal / Cash-Out

After a Cycle, if the Customer wishes to refund the entire amount of a Deposit Certificate, as
well as any earned Profit, he/she is allowed to withdraw this amount under the following
conditions:

- The Customer’s Account should be a Premium Account. This means the Customer should
upload valid identification documents (ID, Passport and/or Driving License, in addition to a
Residence Permit if needed) to his/her Account, and these documents should be reviewed
and approved by CASHU.

- One Cycle at least should pass before the Customer can ask for a withdrawal / cash-out.

- If the amount to be withdrawn / cashed-out was less than $500.00, it can be refunded to
the Customer’s CASHU Account, but cannot be withdrawn / cashed-out.

- If the amount to be withdrawn / cashed-out was between $500.00 and $1,000.00, the
Customer should bear any applicable transfer fees.

- If the amount to be withdrawn / cashed-out was above $1,000.00, CASHU will bear any
applicable transfer fees.

5. Discontinuance of Service

CASHU may, at any time, at its sole discretion, discontinue the Savings Program without notice
to the Customer, and will return any amount in the Deposit Certificates to the Customer
Account.

6. Liability

6.1. CASHU shall not have any liability for any damage, loss, expense or liability of any nature
which may be suffered or incurred except to the extent of direct losses or expenses
attributable to CASHU’s gross negligence or willful misconduct. CASHU shall not, in any
event, be liable for indirect, special, consequential or punitive loss or damage of any kind
(including, but not limited to lost profits), whether or not foreseeable, even if CASHU has
been advised of the likelihood of such loss or damage, and regardless of whether the
claim for loss or damage is made in negligence, gross negligence, for breach of Terms
and Conditions or otherwise; provided, however, that the foregoing shall not apply to
the extent such loss or damage is caused by fraud on the part of CASHU.

6.2. CASHU, its directors, employees, agents and affiliates will not be liable for any loss or
damage (whether direct or indirect or consequential loss or damage) whatsoever
(including, without limitation, loss of business, opportunity, data, goodwill or profits)
arising out of or in connection with your use of the Service, your Customer Account
and/or the CASHU Service (or any part thereof) whether caused by negligence or
otherwise, including without limitation arising out of or in connection with:

a) Any fraud, deception or misrepresentations as a result of any act, omission or


negligence by you in relation to your CASHU Account;

b) Any errors or omissions in the Service content;

c) Misuse of the Service or the inability of any person to use the Service;

d) Delays, losses, errors, or omissions resulting from failure of any telecommunications


or any other data transmission system and the failure of any central computer
system, servers or any part thereof; and

e) The results of acts of any governmental or other authority, any act of God or other
force majeure event.

6.3. If you are dissatisfied with the Service, your sole and exclusive remedy is to discontinue
your use of the Service in accordance with these Terms and Conditions.

7. Intellectual Property

7.1. "CASHU" and "cashu.com" and all related and all other URLs, logos, page headers,
custom graphics, button icons and scripts (in English and Arabic), described on the
Service sections are either service marks, trademarks or registered trademarks of CASHU
or its affiliates. You may not copy, imitate or use them without CASHU's prior written
consent.

7.2. This Service and its content (including without limitation the design, text. and graphics)
and all software and source codes connected with the Service are protected by copyright,
trademarks, patents and other intellectual property rights and laws. None of the content
may be downloaded, copied, reproduced, transmitted, stored, sold or distributed
without the prior written consent of CASHU. All right, title and interest in and to the
Service and its content (including software) is the exclusive property of CASHU, its
affiliates and/or its licensors (as applicable).

8. Notice and Communication

8.1. CASHU may change these Terms and Conditions or impose other restrictions, as CASHU
deems necessary in the course of its business, at any time.

8.2. ("Communications") means without restriction, any announcements, notices, Account


or transaction information that CASHU provides to you, such as any CASHU rules and
regulations you agree to, including updates to these Terms and Conditions or any other
document that we are required to make available to you.

8.3. You acknowledge and agree to receive communications from us electronically


("Electronic Communication”). We will communicate with you by email or by posting
notices on CASHU website.

8.4. You will provide any notices to us by mail to CASHU's postal address or by using the
CASHU Customer Support system on our website. Such notice shall be deemed received
by CASHU only after you have received a written or electronic communication confirming
receipt from CASHU.

8.5. You may communicate with us in relation to any matter including, without limitation,
general queries, discrepancies, claims or disputes by using the CASHU Customer Support
system on the website.

8.6. It is your responsibility to keep your primary email address up-to-date so that CASHU can
communicate with you electronically. You understand and agree that if CASHU sends you
an Electronic Communication, but you do not receive it because your primary email
address on file is incorrect, out of date, blocked by your service provider or you are
otherwise unable to receive Electronic Communications; CASHU will be deemed to have
provided the Communication to you effectively. Please note that if you use a spam filter
that blocks or re-routes emails from senders not listed in your email address book, you
must add CASHU to your email address book so that you will be able to view the
Communications we send to you.

You can update your primary email address or street address at any time by logging into
CASHU's website. If your email address becomes invalid that the Electronic
Communications sent to you by CASHU are returned, CASHU shall consider your Account
as inactive, and you will not be able to transact any activity using your CASHU Account
until we receive a valid, working primary email address from you.

8.7. Calls or Text Messages to Your Mobile Number:

- It is your responsibility to keep your mobile number up-to-date. By providing CASHU


a mobile number, you agree to receive autodialed and prerecorded message calls at
this number. The ways in which you provide us a mobile number include, but are not
limited to, providing a mobile number at CASHU registration, and adding a mobile
number to your CASHU Account at a later time by contacting us from that mobile
number. You consent to receive SMS or text messages at your mobile number for
service-related matters. Standard telephone minutes and text charges may apply if
we contact you.

- In case CASHU failed to reach you through one of the means of Communication
(mobile), CASHU may deem your Account to be inactive, and you will not be able to
transact any activity using your CASHU Account until we receive a valid and verifiable
mobile number from you, where you acknowledge and agree that such actions shall
not make CASHU liable in any way.

8.8. Recording Calls: You understand and agree that CASHU may, without further notice or
warning and in our discretion, monitor or record the telephone conversations you or
anyone acting on your behalf have with CASHU or its agents for quality control and
training purposes or for its own protection. You acknowledge and understand that, while
your Communications with CASHU may be overheard, monitored, or recorded without
further notice or warning, not all telephone lines or calls may be recorded by CASHU, and
CASHU does not guarantee that recordings of any particular telephone calls will be
retained or retrievable.

9. Amendments

You acknowledge and agree that CASHU may make amendments to these Terms and Conditions
from time to time. We shall endeavor to give you notice of any amendments to these Terms
and Conditions that materially increase your obligations or materially decreasing your rights
("Substantial Amendment"); such notice to be provided in accordance with these Terms and
Conditions. You acknowledge and agree that CASHU may, at its sole discretion and without
liability, make amendments that are not Substantial Amendments without your further specific
agreement, at any time and will be effective at the time we post it with immediate effect, by
posting a notice of any such amendments on our website.

Generally, it is your responsibility to log in to your CASHU Account and CASHU Savings Program
and check for updates and amendments referred to above, and also to open and review
Electronic Communications that we deliver to you through those means. We may, but are not
obliged under these Terms and Conditions, provide you with a notice of posting a
Communication to your CASHU Account or CASHU Savings Program.

10. General

10.1. If these Terms and Conditions are translated into any language other than English, in case
of any discrepancy or question of interpretation (including between the English and any
Arabic version of these Terms and Conditions), the English version shall prevail.

10.2. If any clause of these Terms and Conditions shall be deemed invalid, void or for any
reason unenforceable, such clause shall be deemed severable and shall not affect the
validity and enforceability of the remaining clauses of these Terms and Conditions.

11. Disputes with CASHU

11.1. If any dispute, claim, controversy or difference (including in relation to any tortious or
statutory claim) ("Dispute") arises out of or in connection with or in relation to these
Terms and Conditions, then the Parties shall first attempt amicably to settle the Dispute
through good-faith negotiations over a period of thirty (30) calendar days commencing
on the date that a Party first sends to the other Party a written notice of the Dispute. In
the event that a Dispute has not been settled amicably by the relevant Parties by the end
of such thirty (30) day-period, the Parties hereby agree that the Dispute shall be referred
to and finally resolved as described in Section (12) below; except if otherwise agreed by
the Parties.

11.2. CASHU's failure to act with respect to a breach by you or others does not waive CASHU's
right to act with respect to subsequent or similar breaches.

11.3. You are responsible for all liabilities, financial or otherwise, incurred by CASHU, a
Customer, or a third party caused by or arising out of your breach of these Terms and
Conditions, your use of CASHU Savings Program, and any use of your CASHU Account.
You agree to reimburse CASHU, a Customer, or a third party for any and all such liability,
to the extent not prohibited by the applicable law. The consequence of any breach of the
rules and regulations of these Terms and Conditions will be covered by these Terms and
Conditions.

11.4. Reimbursement for Your Liability: To the extent permitted by law, we may collect from
you any obligations that you owe us under these Terms and Conditions. To the extent
permitted by law, we may also collect from you, by any collection means available to us,
any amounts we pay or incur in connection with reimbursable claims.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of
Singapore. The courts of Singapore have exclusive jurisdiction to settle any dispute arising out
of or in connection with these Terms and Conditions (including a dispute regarding the
existence, validity or termination of these Terms and Conditions).
