AFFIDAVIT OF WITNESS

I, MENARD TABORADA, of legal age, Filipino, single, and a resident of

Barangay Abnate, Kiblawan Davao del Sur, after having been duly sworn to in
accordance with law, do herby depose and say THAT:

I am the same and identical person who caused the execution of this Affidavit of
Witness.

That sometime on August 14, 2017 at on or about 4:30 in the afternoon I was
making coffee in the Nipa hut of Barangay Captain Herbert Taborada which Nipa hut is
just in front of the house of Demetrio Dalumatan.

That I saw Kagawad Richard Bulane, Darwin Kinoc and Mario Pandoy inside the
house Demetrio Dalumatan who was also present at that time having a conversation
but not audible from where I was sitting. Mario Pandoy went home and when he came
back he suddenly took out his gun and pointed it at the head of Richard Bulane who
looked seriously shocked and frightened;

Then I saw Darwin Kinoc and Demetrio Dalumatan held Mario Pandoy and tried
to seize the gun from his possession while Richard Bulane hurriedly went home. Mario
Pandoy and his two sons followed him home and I saw them aimed their long barrel
firearms at the house of Richard Bulane;

That I was afraid that they will see me so I immediately ran home after what I
witnessed and did not know what happened after that;

That I am executing this Affidavit of Witness to attest to the truth and veracity of
the foregoing statements and to support the complaint filed by Richard Bulane against
MARIO B. PANDOY for the crime of Attempted Murder and HEARTY FREXS
PANDOY and HEART KIVEN PANDOY.
