AFFIDAVIT

I, KING PAUL J. ABAYA , of legal, single, Filipino citizen and

presently residing at Barangay Vira, Roxas, Isabela, Philippines, after having
been duly sworn to in accordance with law hereby depose and state that:

1. In the afternoon of January , 2014, I went to my stall along the

corner of Magsaysay Avenue and Dizon Subdivision where I
usually sells barbeque;

2. On or about 11;30 o’clock in the evening of the same date and

while attending to my stall, I noticed almost seven (7) male
persons standing at the waiting shed located just at the entrance of
the Dizon Subdivision road and across the place where my stall is
located. Minutes thereafter, my attention was focused on the two
(2) male persons coming from the other road where one of them
has a loud voice while they were talking to each other and went to
the waiting shed where the seven (7) male persons were standing;

3. While observing them at the waiting shed, one (1) of the two (2)
male persons went to the road and I saw one (1) of the seven (7)
male persons wearing light colored stripe and wearing a cap with
big body suddenly boxed the other male person (companion of the
male person who went to the road) and the latter was down to the
pavement;

4. When the person at the road is about to see his companion who
was lying at the pavement, some of the seven (7) male persons met
the male person on the road and started to maul him and thereafter,
this lone person dropped on the ground where he was kicked and
boxed by the other group. I heard also somebody blowing his
whistle coming from the direction of the Barangay Hall of Dizon
Subdivision I believed to be a Tanod where the group of this seven
(7) male persons all ran towards the direction going to Camdas
road while the Tanod pursued them;

5. Noticing that the person boxed at the waiting shed is still lying at
the pavement unconscious, I decided to help them together with a
male person and three (3) women and thereafter assisted the
victims boarded a Taxi cab and they were brought to the hospital;

6. When I was standing at my stall, the Tanod who pursued the seven
(7) persons who mauled the victims came back, he asked me what
 actually happened where I told him what I only saw or witnessed
and he left;

FINALLY, I am executing this affidavit to attest to the truthfulness

and veracity of all the foregoing declarations and for all legal intents and
purposes this may serve.
