These are the general issues that I have encountered while studying the 2019 Amendments to the Rules of Civil Procedure:
1. In order to fully understand the amendments that were done on the
Rules of Civil Procedure, it is important to know or master the 1997 version. Reading the amendments without having studied the 1997 Rules of Civil Procedure was a difficult task since most of the provisions are new to me, as I have not taken Civil Procedure before. I had to compare the old version to the new one, and it could have been better if I have already studied the past version for me to grasp the changes made. 2. Studying the 2019 Amendments could be done better if accompanied with cases, in order to see the application of the new procedures. We may be able to see why the Court decided to change a certain procedure because it has been exhibited in past cases, and we can also see how the changes could affect court proceedings at present. 3. In studying the 2019 Amendments, it could be helpful to divide the entire text into each Rule. Through such an act, it would be easier to understand and master, instead of reading the entire 2019 Amendments to the Rules of Civil Procedure. As such, it could also be more convenient to crosscheck the amended rule from the old version of it. 4. Thinking of the reasons why these changes are made to the 1997 Rules on Civil Procedure has aided me in understanding the amendments. It is very important to know what were the advancements in technology that the Supreme Court took into consideration and the developments in the Philippine legal system that could have affected the amendments. 5. It is vital to have an annotated book alongside the 2019 Amendments. As I have stated earlier, I haven’t taken up Civil Procedure in the past, so I do not understand a lot of provisions. Whenever I don’t understand a certain provision, I could just go and check the book by Dean Riano and read further. This has helped me understand the amendments.
