Re: Review, comment, and recommendation on Municipal Ordinance No.

010-2019, instituting measures to counteract bullying committed among
elementary pupils and high school students in the Municipality of Sibalom.

Greetings!

The Provincial Legal Office is of the opinion that:

1. The Ordinance is not contrary to the Constitution, any law, order, or

other ordinance.

2. That it is in accordance with Section 16 of the Local Government Code

of 1991, which provides for promotion of the general welfare of the

members of the community of the Local Government Unit. It

specifically provides that local government units shall ensure and

support, among other things, the preservation and enrichment of

culture, promote health and safety, enhance the right of the people to

a balanced ecology, encourage and support the development of

appropriate and self-reliant scientific and technological capabilities.

3. That it is in accordance with the rights provided under P.D 603 which

states that Every child has the right to protection against exploitation,

improper influences, hazards, and other conditions or circumstances

 prejudicial to his physical, mental, emotional, social and moral

development. It further provides that every child have the right to the

care, assistance, and protection of the State, particularly when his

parents or guardians fail or are unable to provide him with his

fundamental needs for growth, development, and improvement.
