Laws in the Philippines that is related to the psychological or cognitive aspect in the workplace.

1. Republic Act No. 11036

An Act Establishing a National Mental Health Policy for the Purpose of Enhancing the
Delivery of Integrated Mental Health Services, Promoting and Protecting the Rights of
Persons Utilizing Psychosocial Health Services, Appropriating Funds Therefor and Other
Purposes.

This Act shall be known as the "Mental Health Act."

The state affirms the basic right of all Filipinos to mental health as well as the fundamental
rights of people who require mental health services.

The state commits itself to promoting the well-being of people by ensuring that; mental
health is valued, promoted and protected; mental health conditions are treated and
prevented; timely, affordable, high quality, and culturally-appropriate mental health case
is made available to the public; mental health service are free from coercion and
accountable to the service users; and persons affected by mental health conditions are
able to exercise the full range of human rights, and participate fully in society and at work
free from stigmatization and discrimination.

The State shall comply strictly with its obligations under the United Nations Declaration of
Human Rights, the Convention on the rights of Persons with Disabilities, and all other
relevant international and regional human rights conventions and declarations. The
applicability of Republic act No. 7277, as amended, otherwise known as the "Magna Carta
for Disabled Persons", to person with mental health conditions, as defined herein, is
expressly recognized.

2. Republic act No. 7277

An Act Providing for the Rehabilitation, Self-Development and Self-Reliance of Disabled


Person and Their Integration into the Mainstream of Society and for Other Purposes.

This Act shall be known and cited as the Magna Carta for Disabled Persons.

The grant of the rights and privileges for disabled persons shall be guided by the following
principles:

a) Disabled persons are part of the Philippine society, thus the Senate shall give full
support to the improvement of the total well-being of disabled persons and their
integration into the mainstream of society.

Toward this end, the State shall adopt policies ensuring the rehabilitation, self-
development and self-reliance of disabled persons.

It shall develop their skills and potentials to enable them to compete favorably for
available opportunities.

b) Disabled persons have the same rights as other people to take their proper place in
society. They should be able to live freely and as independently as possible. This must
be the concern of everyone the family, community and all government and non-
government organizations. Disabled person’s rights must never be perceived as
welfare services by the Government.

c) The rehabilitation of the disabled persons shall be the concern of the Government in
order to foster their capability to attain a more meaningful, productive and satisfying
life. To reach out to a greater number of disabled persons, the rehabilitation services
and benefits shall be expanded beyond the traditional urban-based centers to
community based programs, that will ensure full participation of different sectors as
supported by national and local government agencies.

d) The State also recognizes the role of the private sector in promoting the welfare of
disabled persons and shall encourage partnership in programs that address their
needs and concerns.

e) To facilitate integration of disabled persons into the mainstream of society, the State
shall advocate for and encourage respect for disabled persons. The State shall exert
all efforts to remove all social, cultural, economic, environmental and attitudinal
barriers that are prejudicial to disabled persons.

3. Republic Act No. 11058

An Act Strengthening Compliance with Occupational Safety and Health Standards and
Providing Penalties for Violations Thereof

The State affirms labor as a primary social and economic force, and that a safe and healthy
workforce is an integral aspect of nation building.

The State shall ensure a safe and healthful workplace for all working people by affording
them full protection against all hazards in their work environment. It shall ensure that the
provisions of the Labor Code of the Philippines, all domestic laws, and internationally-
recognized standards on occupational safety and health are being fully enforced and
complied with by the employers, and it shall provide penalties for any violation thereof.

The State shall protect every worker against injury, sickness or death through safe and
healthful working conditions thereby assuring the conservation of valuable manpower

resources and prevention of loss or damage to lives and properties consistent with
national development goals, and with the State's commitment to the total development of
every worker as a complete human being.

The State, in protecting the safety and health of the workers, shall promote strict but
dynamic, inclusive, and gender-sensitive measures in the formulation and implementation
of policies and programs related to occupational safety and health.

This Act shall apply to all establishments, projects, sites, including Philippine Economic
Zone Authority (PEZA) establishments, and all other places where work is being
undertaken in all other places where work is being undertaken in all branches of economic
activity, except in public sector.

The Secretary of Labor and Employment shall issue the number of employees, and nature
of operations, and the risk or hazard involved.

4. Republic Act No. 7877

An Act Declaring Sexual Harassment Unlawful In the Employment, Education or Training


Environment, And For Other Purposes

This Act shall be known as the “Anti-Sexual Harassment Act of 1995.”

The State shall value the dignity of every individual, enhance the development of its
human resources guarantee fell respect for human rights, and uphold the dignity of works,
employees, and applicants for employment, students or those undergoing training,
instruction or education. Towards this end, all forms of sexual harassment in the
employment, education or training environment are hereby declared unlawful.

5. Republic Act No. 7877

An Act Prohibiting Discrimination against Any Individual in Employment on Account of Age


and Providing Penalties Therefor

This Act shall be known as the "Anti-Age Discrimination in Employment Act".

The State shall promote equal opportunities in employment for everyone. To this end, it
shall be the policy of the State to:

a) Promote employment of individuals on the basis of their abilities, knowledge, skills and
qualifications rather than their age.

b) Prohibit arbitrary age limitations in employment.

c) Promote the right of all employees and workers, regardless of age, to be treated
equally in terms of compensation, benefits, promotion, training and other employment
opportunities.

6. Republic Act No. 8371

An Act To Recognize, Protect And Promote The Rights Of Indigenous Cultural


Communities/Indigenous Peoples, Creating A National Commission On Indigenous
Peoples, Establishing Implementing Mechanisms, Appropriating Funds Therefor, And For
Other Purposes

This Act shall be known as “The Indigenous Peoples’ Rights Act of 1997”.

The State shall recognize and promote all the rights of Indigenous Cultural
Communities/Indigenous Peoples (ICCs/IPs) hereunder enumerated within the framework
of the Constitution:

a) The State shall recognize and promote the rights of ICCs/IPs within the framework of
national unity and development;

b) The State shall protect the rights of ICCs/IPs to their ancestral domains to ensure their
economic, social and cultural well-being and shall recognize the applicability of
customary laws governing property rights or relations in determining the ownership
and extent of ancestral domain;

c) The State shall recognize, respect and protect the rights of ICCs/IPs to preserve and
develop their cultures, traditions and institutions. It shall consider these rights in the
formulation of national laws and policies;

d) The State shall guarantee that members of the ICCs/IPs regardless of sex, shall
equally enjoy the full measure of human rights and freedoms without distinction or
discrimination;

e) The State shall take measures, with the participation of the ICCs/IPs concerned, to
protect their rights and guarantee respect for their cultural integrity, and to ensure that
members of the ICCs/IPs benefit on an equal footing from the rights and opportunities
which national laws and regulations grant to other members of the population; and

f) The State recognizes its obligations to respond to the strong expression of the
ICCs/IPs for cultural integrity by assuring maximum ICC/IP participation in the direction
of education, health, as well as other services of ICCs/IPs, in order to render such
services more responsive to the needs and desires of these communities.

Towards these ends, the State shall institute and establish the necessary mechanisms to
enforce and guarantee the realization of these rights, taking into consideration their
customs, traditions, values, beliefs, interests and institutions, and to adopt and implement
measures to protect their rights to their ancestral domains.
