AFFIDAVIT OF DESISTANCE

I, ARNEL G. CABALLERO, of legal age, married, and with office address located
at Solid Motorcycle Distributors Inc., A.S. Fortuna St., Banilad, Mandaue City, after
having been duly sworn to in accordance with law, do hereby depose and say:

1. That I am the authorized representative of the private complainant Solid

Motorcycle Distributors Inc. in Criminal Case No. DNO-8603 now pending
before the Regional Trial Court of Danao City Branch 25,

2. That the accused in the above-mentioned case has already fully paid her
civil liabilities in the amount of P87,154.00 plus 10% attorney’s fees.

3. That in view of the fact of the civil liabilities of the accused has been fully
paid already, the private complainant Solid Motorcycle Distributors Inc., a
corporation duly organized and existing under the laws of the Republic of the
Philippines, has decided to forego the prosecution of the above-mentioned criminal
case and the herein duly authorized representative heretofore executes the instant
affidavit of desistance so that the above-mentioned came shall be dismissed.

4. That I execute this affidavit of desistance freely and voluntarily to attest to

the truth of the foregoing and so that the above-mentioned case may be dismissed.
