Explaining what a law says

Article 15, first paragraph, form the Romanian Criminal Code stipulates that "the crime is the deed
provided by the criminal law, committed with guilt, unjustified and imputable to the person who
committed it." The first paragraph determines the sense of this notion by a prohibitive sentence, stating
that the crime is committed with guilt, unjustified and imputable to the person who did it. The
unjustified character of the crime regulates the illicit and unpermitted behavior of the individual which
makes the deed. This unjustified character may be found any time when the deed is not affected by
justifiable causes. Also the deed has to be stipulated in the Romanian Criminal Code in order to be
regarded as a crime, otherwise nobody can be punished (persons or companies) for a deed which is not
mentioned as a crime.

In the second paragraph of article 15 is specified that "the committed crime is the only basis of criminal
liability". In this case the second paragraph lays down a rule, that one is subjected to criminal liability
only if the person committees a crime. The established rule applies in the same manner to persons and
companies. Companies are subjected to criminal liability in the same way as the persons, there is no
difference between them regarding the committed crime. Even the authorities are subjected to the
present rule and present article.
