PROPOSED ORDINANCE PO21CC-_______, S, 2020

AN ORDINANCE MANDATING THE USE OF FACE SHIELDS IN QUEZON CITY.

AND COUNCILOR DOROTHY A. DELARMENTE, M.D.

WHEREAS, Article II, Section 15 of the 1987 Philippine Constitution provides


that the State shall protect and promote the right to health of the people and instill
health consciousness among them;

WHEREAS, On March 8, 2020, President Rodrigo R. Duterte issued


Proclamation No. 922, S-2020 declaring a State of Public Health Emergency
throughout the country in recognition of the COVID-19 public health event as a
threat to national security, and to prompt a whole-of-government approach in
addressing the outbreak in the country;

WHEREAS, upon recommendation of the Inter-Agency Task Force for the


Management of Emerging Infectious Disease in the Philippines (IATF), the President
directed the adoption of stringent social distancing and community quarantine
measures and guideline in the National Capital Region (NCR) effective March 15,
2020, to contain the spread of COVID-19;

WHEREAS, Presidential Proclamation No. 929, S-2020 signed on March 16,


2020, declared a State of Calamity throughout the country due to COVID-19 for a
period of six (6) months and enjoined all government agencies and the LGUs to
render full assistance to and cooperation with each other, and mobilize the
necessary resources to undertake critical, urgent and appropriate disaster response
aid and measures in a timely manner to curtail and eliminate the threat of Covid-
19;

WHEREAS, on April 30, 2020, President Rodrigo R. Duterte issued Executive


Order No. 112, s. 2020 entitled: IMPOSING AN ENHANCED COMMUNITY
QUARANTINE IN HIGH-RISK GEOGRAPHIC AREAS OF THE PHILIPPINES AND A
GENERAL COMMUNITY QUARANTINE IN THE REST OF THE COUNTRY FROM 01
TO 15 MAY 2020, ADOPTING THE OMNIBUS GUIDELINES ON THE
IMPLEMENTATION THEREOF, AND FOR OTHER PURPOSES;

WHEREAS, on May 15, 2020 during the 37th Inter-Agency Task Force
Meeting, the IATF approved the Omnibus Guidelines on the Implementation of
Community Quarantine in the Philippines, in order to harmonize and codify
existing policies of the IATF and member-agencies pertaining to community
quarantine, which shall be applied to all regions, provinces, cities, municipalities
and barangays placed under community quarantine.

WHEREAS, On August 3, 2020, the Department of Transportation (DoTr)


issued Memorandum Circular No. 2020-014, mandating the wearing of face shields
for passengers using public transportation effective August 15, 2020;

WHEREAS, On August 15, 2020, the Department of Trade and Industry (DTI)
and Department of Labor and Employment (DOLE) issued Joint Memorandum
Circular No. 20-04-A Series of 2020 entitled “DTI AND DOLE SUPPLEMENTAL

GUIDELINES ON WORKPLACE PREVENTION AND CONTROL OF COVID-19” which


states that:

b. Face shields
i. Face shields shall cover the entire face (completely cover the
sides and length of the face). If possible, face shields should
extend to the ears and below the chin.
ii. Visor-type face shields shall not be allowed.
iii. Face shields and masks should always be worn together
when interacting with colleagues, clients and/or visitors.
iv. Face shields may be removed according to the demands of
the work or when the occupational safety and health of the
employees so requires.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR


SESSION ASSEMBLED:

Section 1. TITLE. This Ordinance shall be known as the FACE SHIELD


ORDINANCE OF QUEZON CITY.

Section 2. DECLARATION OF POLICY AND COVERAGE. It shall be the


policy of the Quezon City Government that all people, residents or
transients/visitors, shall use Face Shield together with Face Mask within the
territorial jurisdiction of Quezon City.

The following shall be included as part of the minimum public health


standards to be complied with at all times in Quezon City.
1. Face shields shall cover the entire face (completely cover the
sides and length of the face). If possible, face shields should
extend to the ears and below the chin.
2. Visor-type face shields shall not be allowed.
3. Face shields and masks should always be worn together when
interacting with colleagues, clients and/or visitors.
4. Face shields may be removed according to the demands of the
work or when the occupational safety and health of the
employees so requires.
5. Face shields shall be required upon boarding any public
transportation including Company Shuttle Services or any
allowed group/mass transportation.

Face shield shall be defined as any mask, typically made of clear plastic,
that protects the mucous membranes of the eyes, nose, and mouth that carry the
risk of generating splashes of blood, body fluids, excretions, or secretions.

Section 3. EXEMPTIONS. The following activities are exempted from using


face shields:
1. They are within their residences and residential property such as
lawn, garden, among others, but use of face shield is still
encouraged when interacting with visitors including delivery
services.
2. They are within their personal vehicle except for those using tricycle,
pedicabs, bicycle. Motorcycles riders are also exempted since they
are wearing their helmets.
3. They are eating or drinking inside restaurants or in designated areas
of food shops/stalls. Eating or drinking while walking is
discouraged.

4. When there is a sufficient protection such as set-up of glass, acrylic


or plastic division (without any holes or gaps) in the work area.
5. Other exemtions that may be determined by the City Health
Department subject to the approval of the City Mayor.

Section 4. PENALTIES. Any person, corporation, entity or agency that shall


violate this ordinance shall suffer the following penalties:

1) For the first violation - a fine of one thousand pesos (₱1,000.00)


2) For any subsequent violation a fine of two thousand pesos (₱2,000.00)

If the offender is a corporation, partnership or organization or any similar


entity, the employees and officials therefore directly involved shall individually be
held liable therefore.

Upon filing of an appropriate complaint and after due notice and hearing, the
Business Permit and Licensing Department (BPLD), may also cause the cancellation
or revocation of the business permit, permit to operate, franchise and other similar
privileges granted to any business that fails to abide by the provision of this
ordinance.

If the violator is an alien or a foreigner, he shall be deported immediately


after service of sentence without further deportation proceedings.

Section 5. IMPLEMENTING RULES. All provisions of this Ordinance which


are executory in nature, shall be immediately implemented. The Business Permit
and Licensing Department (BPLD) in coordination with the City Health Department
the Disaster Risk Reduction and Management Office and other pertinent
department or office, the may promulgate additional rules and regulations for the
smooth implementation of this ordinance.

Section 6. REPEALING CLAUSE. All ordinances, resolutions, executive


issuances, or rules and regulations, or parts thereof, whose provisions are
inconsistent with or contrary to the provisions of this Ordinance, are hereby
deemed repealed, amended, or modified accordingly.

Section 7. SEPARABILITY CLAUSE. If, for any reason, any section or


provision of this Ordinance is held unconstitutional or invalid, the other sections or
provisions hereof shall not be affected thereby.

Section 8. EFFECTIVITY. This ordinance shall take effect immediately upon


its approval.
