PROPOSED ORDINANCE NO. PO21CC-_______, S, 2020

AN ORDINANCE REPEALING ORDINANCE NO. SP-2914, S. 2020,


ENTITLED “AN ORDINANCE REGULATING THE SELLING OF BASIC
NECESSITIES DURING CALAMITIES AND OTHER EMERGENCY
SITUATION OCCURRING WITHIN THE TERRITORIAL JURISDICTION OF
QUEZON CITY” AS AMENDED BY ORDINANCE NO. SP-________, S. 2020,
THEREBY LIFTING THE RESTRICTIONS ON SELLING OF BASIC
NECESSITIES IN QUEZON CITY.

WHEREAS, On March 8, 2020, President Rodrigo R. Duterte issued


Proclamation No. 922, S-2020 declaring a State of Public Health Emergency
throughout the country in recognition of the COVID-19 public health event
as a threat to national security, and to prompt a whole-of-government
approach in addressing the outbreak in the country;

WHEREAS, upon recommendation of the Inter-Agency Task Force for


the Management of Emerging Infectious Disease in the Philippines (IATF),
the President directed the adoption of stringent social distancing and
community quarantine measures and guideline in the National Capital
Region (NCR) effective March 15, 2020, to contain the spread of COVID-19;

WHEREAS, Presidential Proclamation No. 929, S-2020 signed on


March 16, 2020, declared a State of Calamity throughout the country due to
COVID-19 for a period of six (6) months and enjoined all government
agencies and the LGUs to render full assistance to and cooperation with
each other, and mobilize the necessary resources to undertake critical,
urgent and appropriate disaster response aid and measures in a timely
manner to curtail and eliminate the threat of Covid-19;

WHEREAS, to prevent panic buying and hoarding during the state of


calamity and quarantine period, the Quezon City Council enacted
ORDINANCE NO. SP-2914, S. 2020, ENTITLED “AN ORDINANCE
REGULATING THE SELLING OF BASIC NECESSITIES DURING
CALAMITIES AND OTHER EMERGENCY SITUATION OCCURRING
WITHIN THE TERRITORIAL JURISDICTION OF QUEZON CITY”;

WHEREAS, on May 16, 2020 the IATF placed Metro Manila on


Modified Enhanced Community Quarantine. Metro Manila was placed
further to General Community Quarantine on June 1, 2020 which lifted
several restrictions on the mobility and access of people to essential goods;

WHEREAS, considering the grave improvement of the supply situation


of the country, the region and the city, there is a need to remove any

impediments for the people in buying / purchasing basic necessities that


they need and want;

WHEREAS, the lifting of the regulations imposed on the selling of


basic necessities by the ordinance would also improve the economic
situation within the city;

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN


REGULAR SESSION ASSEMBLED:

Section 1. Ordinance No. SP-2914, S. 2020, entitled “AN ORDINANCE


REGULATING THE SELLING OF BASIC NECESSITIES DURING CALAMITIES
AND OTHER EMERGENCY SITUATION OCCURRING WITHIN THE
TERRITORIAL JURISDICTION OF QUEZON CITY” as amended by Ordinance
No. SP-________, S. 2020 is hereby repealed.

Section 2. Repealing Clause. All ordinances, resolutions, executive


issuances, or rules and regulations, or parts thereof, whose provisions are
inconsistent with or contrary to the provisions of this Ordinance, are hereby
deemed repealed, amended, or modified accordingly.
   

Section 3. Separability Clause. If, for any reason, any section or


provision of this Ordinance is held unconstitutional or invalid, the other
sections or provisions hereof shall not be affected thereby.

Section 4. Effectivity. This ordinance shall take effect immediately


upon its approval.
