PROPOSED ORDINANCE PO21CC-_______, S, 2020

AN ORDINANCE MANDATING ALL BUSINESS ESTABLISHMENTS IN QUEZON CITY TO


STRICTLY IMPLEMENT SOCIAL DISTANCING PROTOCOLS PURSUANT TO THE OMNIBUS
GUIDELINES ON THE IMPLEMENTATION OF COMMUNITY QUARANTINE IN THE
PHILIPPINES ISSUED BY THE INTER-AGENCY TASK FORCE FOR THE MANAGEMENT OF
EMERGING INFECTIOUS DISEASE IN THE PHILIPPINES (IATF).

WHEREAS, Article II, Section 15 of the 1987 Philippine Constitution provides that the
State shall protect and promote the right to health of the people and instill health consciousness
among them;

WHEREAS, On March 8, 2020, President Rodrigo R. Duterte issued Proclamation No.


922, S-2020 declaring a State of Public Health Emergency throughout the country in recognition
of the COVID-19 public health event as a threat to national security, and to prompt a whole-of-
government approach in addressing the outbreak in the country;

WHEREAS, upon recommendation of the Inter-Agency Task Force for the Management
of Emerging Infectious Disease in the Philippines (IATF), the President directed the adoption of
stringent social distancing and community quarantine measures and guideline in the National
Capital Region (NCR) effective March 15, 2020, to contain the spread of COVID-19;

WHEREAS, Presidential Proclamation No. 929, S-2020 signed on March 16, 2020,
declared a State of Calamity throughout the country due to COVID-19 for a period of six (6)
months and enjoined all government agencies and the LGUs to render full assistance to and
cooperation with each other, and mobilize the necessary resources to undertake critical, urgent
and appropriate disaster response aid and measures in a timely manner to curtail and eliminate
the threat of Covid-19;

WHEREAS, on April 30, 2020, President Rodrigo R. Duterte issued Executive Order No.
112, s. 2020 entitled: IMPOSING AN ENHANCED COMMUNITY QUARANTINE IN HIGH-RISK
GEOGRAPHIC AREAS OF THE PHILIPPINES AND A GENERAL COMMUNITY QUARANTINE IN
THE REST OF THE COUNTRY FROM 01 TO 15 MAY 2020, ADOPTING THE OMNIBUS
GUIDELINES ON THE IMPLEMENTATION THEREOF, AND FOR OTHER PURPOSES;

WHEREAS, on May 15, 2020 during the 37th Inter-Agency Task Force Meeting, the IATF
approved the Omnibus Guidelines on the Implementation of Community Quarantine in the
Philippines, in order to harmonize and codify existing policies of the IATF and member-agencies
pertaining to community quarantine, which shall be applied to all regions, provinces, cities,
municipalities and barangays placed under community quarantine.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION


ASSEMBLED:

Section 1. Pursuant to Section 3 of the Omnibus Guidelines on the Implementation of


Community Quarantine in the Philippines issued by the Inter-Agency Task Force for the

Management of Emerging Infectious Disease in the Philippines (IATF), the Quezon City
Government hereby mandates that all business establishments shall observe and implement the
Social Distancing protocols including, but not limited to,:

a. Establish Limited Entry and Exit points. Establishments, if possible, shall designate
certain doors as entry and exit points. The Establishments shall ensure that proper
entry and exit markers are in placed and widely visible to their clients;

b. Ensure that Valid Quarantine Pass and Valid Government Identification with address
and date of Birth are checked. The existing rules on use of Face Masks shall still be
implemented. Any person below twenty-one (21) years old, those who are sixty (60)
years old and above, those with immunodeficiency, comorbidities, or other health risks,
and pregnant women, including any person who resides with the aforementioned, shall
not be allowed to enter, except when indispensable under the circumstances for
obtaining essential goods and services. Provided, that, they are issued a valid
Quarantine Pass by their respective Barangay or City;

c. Set up visual, audio and or video announcements on Social Distancing Protocols to


remind their clients to observe social distancing upon entry and while within the
premises;

d. Designate additional security and/or personnel that would implement social


distancing protocols by reminding their clients and/or if necessary enforce said
protocols by asking their clients to leave and/or filing of complaints against violators;

e. Set up designated Social Distancing markers, stickers, chairs, and/or other viable
system to ensure that each client have at least the acceptable social distance, in
waiting areas and throughout their establishment. Provided, that, if said
establishment have limited waiting area, shall designate a cut-off area. Provided,
further that, establishments that have enough area for foot traffic, must implement
one-way flow of traffic with corresponding markers, stickers or other materials to
guide their clients;

f. Establishment shall limit the use of their air-conditioning system to a minimum, in


order to prevent people/clients from staying longer;

g. Ensure that there is a limited operations in malls and shopping centers shall be
allowed, except for leisure establishments and services which shall continue to be
closed. Provided, that establishments and services allowed to operate in malls and
shopping centers may only operate at a capacity consistent with items (4) and (5) of
this Section. Provided, finally, that such operations must comply with the updated
guidelines as may be issued by the DTI and/or the BLPD;

h. Implement other social distancing protocols from previous IATF resolutions or


issuances by the Office of the President and the Office of the City Mayor as applied in
relation to the community quarantine.

Section 2. Any person, corporation, entity or agency that shall violate this ordinance shall
suffer the following penalties:

1) For the first violation - a fine of three thousand pesos (₱3,000.00)


2) For any subsequent violation a fine of three thousand pesos (₱5,000.00)

If the offender is a corporation, partnership or organization or any similar entity, the


employees and officials therefore directly involved shall individually be held liable therefore.

Upon filing of an appropriate complaint and after due notice and hearing, the Business
Permit and Licensing Department (BPLD), may also cause the cancellation or revocation of the

business permit, permit to operate, franchise and other similar privileges granted to any
business that fails to abide by the provision of this ordinance.

Any person who falsifies any document to avail of the benefits provided under this
ordinance or any person who abuses the privileges granted herein shall be punished with a fine
of three thousand pesos (₱3,000.00) and imprisonment of not less than six (6) months, upon
filing of complaint in courts.

If the violator is an alien or a foreigner, he shall be deported immediately after service of


sentence without further deportation proceedings.

Section 3. The Business Permit and Licensing Department (BPLD) shall promulgate the
necessary rules and regulations for the smooth implementation of this ordinance. Provided that,
those provisions which are executory in nature, shall be in effect.

Section 4. Repealing Clause. All ordinances, resolutions, executive issuances, or rules and
regulations, or parts thereof, whose provisions are inconsistent with or contrary to the
provisions of this Ordinance, are hereby deemed repealed, amended, or modified accordingly.
   

Section 5. Separability Clause. If, for any reason, any section or provision of this
Ordinance is held unconstitutional or invalid, the other sections or provisions hereof shall not be
affected thereby.

Section 6. Effectivity. This ordinance shall take effect immediately upon its approval.
