APPLICATION FOR SEARCH WARRANT

COMES NOW, the undesigned Deputy Chief of the Investigation Branch of

Puerto Princesa Police City Office, located in Barangay San Pedro, Puerto Princesa
City, unto this Honorable Court most respectfully avers:

1. That on August 23, 2020, John Cena Y Vera, 40 years old and a
residence of Dimakita St, Barangay Tinago, Puerto Princesa City,
personally appeared to this office and reported that the Juan Dela Cruz
located at Dimakita St, Barangay Tinago, Puerto Princesa City, has in
his possession a Pistol Armscor Cal .45 which he uses to fire every
time he is intoxicated which causes fear and anxiety to the
neighborhood;

2. That, the complainant said that on the same day, after he and the
herein respondent drink at the latter’s house, he saw that the
respondent went inside his room and bring out a firearm which is
inside of a black bag behind the door of his room, and he pointed it
against the herein complainant where he ran as fast as he could and
report the said incident immediately to this office;

3. That, the undesigned caused the investigation and verification of the

report. Witnesses Police Officers Enchong Malabo and Anton Pulgas,
who were able to gain information about the incident and the behavior
of the respondent from his neighbors;
4. That, based on the report of above-named witness, respondent is
causing alarm and scandal in the neighborhood through the use of a
firearm which he keeps inside a black bag which is located behind the
door of his room, which clearly a violation of Article 155 of the Revised
Penal code;

5. Attached are the following to support this application:

a. Barangay Certification issued by the Punong Barangay to
prove that the house to be searched is located in that
barangay;
b. Affidavit of Police Officer Enchong Malabo;
c. Affidavit of Police Officer Anton Pulgas
d. Vicinity sketch of the location of the house
e. Sketch of the house and the location of the items to be
seized
f. And others

6. WHEREFORE, the undersigned most respectfully prays that this

Honorable Court issue a search warrant against the respondent
authorizing the undesigned or any police officer to search the premises
described in paragraph 2; and to seize and bring to this Court the
things or properties stated in the same paragraph.

warrant, read and understood all the allegations therein;

2. The same are true and correct of my own knowledge; and, on

the basis of authenticated documents in my possession; and

3. That I have not commenced any application for search warrant

against the same party in any tribunal or other agency and that
to the best of my knowledge, no such application is pending in
any court, tribunal, or agency and if I learn that a similar
application has been filed or pending before any court, tribunal,
or agency, I shall make the required notification within five (5)
days from receipt thereof.
