Evidence

Define Evidence.

Evidence is the means, sanctioned by the Rules of Court (ROC), of ascertaining in a judicial proceeding,
the truth respecting a matter of fact. (Rule 128, Sec.1)

Are the rules on evidence applicable in all courts and in all trials and hearings?

General Rule: YES (Rule 128, Sec. 2)

Exception: Law and ROC

What is the Quantum of Proof in Criminal Cases?

The prosecution must prove guilt beyond reasonable doubt. (Rule 133, Sec. 2)

Differentiate Proof and Evidence.

Evidence is the mode of proving competent facts in a judicial proceedings. Proof is the result or effect of
evidence.
