As per Order 26 Rule 9 Court can appoint commissioner for local investgations for the purpose of elucidating any matter in dispute, or
of ascertaining the market value of any property or the amount of any mesne profits or damages or annual net profits.

Also section 75(b) of CPC provides the Court with the power to appoint a commissioner for local investigation.

In Sarala Jain v. Sangu Gandadhar [2016(3)ALD197], the court in Para 21 of the judgement said that in order for a court to appoint
commissioner following things are to be kept in mind:

i. Total pleadings of both parties


ii. Relief claimed in suit
iii. Appointment of advocate commissioner for specific purpose at interlocutory stage shall not amount to grant pre-bail decree
iv. Neccesity to appoint advocate commissioner to decide real controversy between parties

The court in the case of Gurram Anantha Reddy v. Katla Sayanna [2015(4)ALD716] in para 13 and 17 said that “The contention that
in Execution Proceedings commissioner cannot be appointed and the Execution Petition court has no power to appoint commissioner
under Order 26 Rule 9 of the CPC has absolutely no merit in view of the reason that as per Order 26 Rule 18-A of CPC, the provisions
of Order 26 of CPC are applicable to the proceedings in execution of a decree or order also.”
