Introduction

Premise

Section 15, Article 2 of the 1987 Constitution states that “The State shall protect
and promote the right to health of the people and instill health consciousness
among them”. With this regard, it is the duty of the State inform its people, to
raise awareness and give stern warning on the possible effects and side effects of
various fad diets such as Keto Diet, Vegan Diet and Intermittent Fasting. This
mandate upon the State is properly enshrined in the Constitution.

Statement of the Problem

Fad diets are extremely popular for losing weight. They typically promise rapid
weight loss and other health benefits, yet often have no scientific evidence
supporting their use. In addition, they are often nutritionally unbalanced and
ineffective over the long term (https://www.healthline.com/nutrition/8-fad-diets-
that-work). It had been noted that many people try these diets with the proper
information on what to consider before starting to apply them. It is this
misinformation that tend to pose harm on the people trying to lose weight.

Objective of the Study

Our study aims to provide information on the nature, benefits and possible side
effects of such diets. We also aim to tackle on the legal side of these, especially on
the Constitutional mandate stated in Article 2, Section 15 of the 1987
Constitution.

Methodology

Our study was conducted by first looking into the general definition and nature of
each diet, how it can be done, and its effects on the health and general well-
being. We also looked into various jurisprudence and laws that may apply and
lastly, we try to look into possible laws that may help regulate the application of
these diets.

Scope and Limitation

We do not promote these diets but rather we seek to provide proper context in
applying these diets and the role the State will play in regulating this.
